Keeping in view the decision of this Court in Ishwar Chandra vs. Oriental Insurance
Co. Ltd., reported in 2007 (4) SCALE 292, we grant liberty to the appellant to recover
the amounts paid and/or to be paid to the claimants, from the owner of the vehicle.
The appeal is disposed of accordingly.
