IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO.2054 OF 2010 (Arising out of SLP(Crl.)No.6545 of 2008) NATIONAL AVIATION CO.OF INDIA LTD.& ORS Appellant(s) VERSUS STATE OF ASSAM & ANR. Respondent(s) O R D E R Leave granted. We have heard learned counsel for the parties. Mr.Lalit Bhasin, learned counsel appearing for the appellants submitted that the services of the 27 employees will not be dispensed with and they would be regularised in a phased manner within three years from today. In view of the statement of Mr.Lalit Bhasin, in our considered view, the Criminal Prosecution cannot be permitted to go on and we, accordingly, quash the Criminal Proceedings pending against the National Aviation Co.of India Ltd. & Ors. before the Court of Chief Judicial Magistrate, Guwahati. The respondents would be at liberty to revive this appeal in case the employees are not regularised within a period of three years. Mr.Lalit Bhasin, learned counsel appearing for the appellants submitted that he would not press the petition before the High Court. The application for intervention is also disposed of.
