ORAL ORDER
This writ petition is filed seeking following prayers:
“i) Issue a writ of certiorari or any other appropriate
writ, order or direction, quashing the impugned
notification dated 14-08-2026 vide Annexure-C,
issued by the respondent no.4 insofar as the same
proceeds to constitute/conduct elections to Hulsoor
Gram Panchayat without considering the proceedings
initiated pursuant to the preliminary notification
dated 08-01-2026 proposing the upgradation of

Hulsoor Gram Pancyhayat into Hulsoor Pattana
Panchayat/Town Panchayat;
ii) Issue a writ of mandamus, or any other direction
or directing the respondent authorities to consider
and conclude, in accordance with law, the
proceedings initiated pursuant to the preliminary
notification dated 08-01-2026 proposing the up
gradation of Hulsoor Gram Panchayat into Hulsoor
Pattana Panchayat/Town Panchayat, before
proceeding further with the constitution/election of
the Hulsoor Gram Panchayat;
iii) Issue writ of mandamus, directing the respondent
no.4 to consider and dispose the representations
dated 01-09-2026 vide Annexure-D series, submitted
by the petitioners, arising the inconsistency between
the preliminary notification dated 08-01-2026 and
the subsequent notification dated 14-08-2026, by
passing an appropriate and reasoned order in
accordance with law;
iv) Consequently, direct the respondent authorities
not to proceed further with the election/constitution
of Hulsoor Gram Panchayat pursuant to the
notification dated 14-08-2026 until the proceedings
initiated pursuant to the preliminary notification
dated 08-01-2026 are considered and concluded in
accordance with law;

v) Grant any other relief that this Honourable Court
deems fit under the facts and circumstances of the
case.”
2. Miss Deeksha N Amruthesh, learned counsel
appearing for the petitioners submits that the respondent
No.4 has issued the notification dated 14.08.2026,
wherein the wards of Hulsoor have been notified by
ignoring the fact that the said Hulsoor is no more a Gram
Panchayat and it is proposed to be a Town Panchayat. It is
further submitted that on noticing such anomaly, the
petitioner No.7 had submitted a detailed representation to
the Deputy Commissioner requesting to withdraw the
notification. Hence, she seeks to allow the petition.
3. Per contra , learned Additional Government
Advocate appearing for the respondents submits that the
Hulsoor was a Gram Panchayat and it was proposed to be
declared as a Town Panchayat. A draft notification was
issued inviting objections. However, no final notification
was issued declaring Hulsoor as a Town Panchayat. Until

the said notification is issued, Hulsoor remains as a Gram
Panchayat. It is submitted that the Deputy Commissioner
has considered the petitioner's representation and issued
an endorsement dated 07.10.2026 and the same is placed
along with a memo.
4. In view of the aforesaid submission of learned
Additional Government Advocate that the Deputy
Commissioner has considered the petitioner's
representation and issued endorsement dated 07.10.2026,
I am of the considered view that no orders need to be
passed in the present petition.
5. In view of the aforesaid observations, the writ
petition is disposed of . It is open for the petitioner to
work out the remedies, in accordance with law.
