PRAYER: S-38 Writ Petition, filed under Article 226 of the
Constitution of India, praying this court to issue a Writ of
Mandamus directing the respondents to forthwith provide suitable
permanent/alternate employment to the Petitioner and ensure the job
protection and continuity of service in accordance with Section 20 of
the Rights of Persons with Disabilities Act, 2016, with the same pay
scale, seniority and service benefits and effect a formal change of
Designation of the Petitioner from Conductor to the appropriate
alternate post and consequently directing the respondents to disburse
all arrears of salary, difference of wages, allowances and other
service benefits for all the periods during which the Petitioner was
wrongfully denied duty or paid reduced wages including the period
2018 to 2021 together with interest thereon and pass such further or
other orders as this Honble Court may deem fit and proper in the
circumstances of the case and thus render justice.

O R D E R
The petitioner, who was working as a Conductor in the
respondent Transport Corporation, has been provided with an
alternative employment, as he has suffered with a fracture in his
right leg. The grievance of this petitioner is that though he has been
provided with an alternative employment, his cadre has not been
re-designated. Therefore, the petitioner is before this Court.
2.Mr.G.Mohan Kumar, learned Additional Government
Pleader takes notice for the first respondent. Mr.P.F.Ferlin Castro,
learned Standing Counsel takes notice for the second and third
respondents and submits that the petitioner has been provided with
an alternative employment on temporary basis, on the ground that he
has suffered a fracture in his leg. Therefore, his post has not been
re-designated. The injuries suffered by this petitioner is only a
fracture and for time being, this petitioner has been provided with an
alternative employment. It is not a permanent ailment and therefore,

there is no need for re-designation of his post.
3. This Court considered the rival submissions made.
4. Admittedly, this petitioner, who was working as
Conductor in the respondent Corporation, has been provided with
alternative employment, based on the injury suffered by him.
Though it is claimed by the respondents that the petitioner has been
provided with alternative employment on temporary basis, now he
cannot be treated as a Conductor, when the petitioner is doing some
other work. Therefore, the respondents are directed to redesignate
his post and can refer the petitioner to Medical Board after a period
of one year. The respondent shall take a call on his alternative
employment, based on the report to be provided by the Medical
board in future.

5. With the above directions, this writ petition stands
disposed of. No costs.
