CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH
and
HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA
ORAL JUDGMENT
Patna High Court L.P.A No.154 of 2026 dt.26-10-2026
2/5
(Per: HONOURABLE MR. JUSTICE SUDHIR SINGH)
Date: 26-10-2026
Heard learned counsel for the parties.
2. The present intra court appeal has been preferred
against the order dated 05.02.2026 passed in C.W.J.C. No.
18237 of 2024, whereby the writ petition preferred by the writ-
petitioner (respondent No. 9 herein) came to be disposed of.
3. The writ petitioner (respondent No. 9 herein)
claims to be an Intermediate College recognised by the
erstwhile Bihar Intermediate Education Council and falling
within the jurisdiction of the Bihar School Examination Board,
Patna. For the academic sessions 2013–15 and 2014–16, the
State Government released grants for disbursement to the
employees of the said college. The amount in question is lying
in the college’s bank account maintained with the State Bank of
India, Nawada. The grievance of the writ petitioner was that the
respondent Bank is not permitting the operation of the said
account, thereby preventing the disbursement of the grant
amount amongst the employees of the college.
4. Aggrieved by the action of the respondent Bank,
the writ petitioner approached this Court by filing C.W.J.C. No.
18237 of 2024. Upon hearing the parties, the learned Single
Judge passed the following order:
Patna High Court L.P.A No.154 of 2026 dt.26-10-2026
3/5
“5. The afore-noted order dated 18.12.2025
has also been questioned by filing interlocutory
application bearing I.A. No. 1 of 2026. The
respondent no. 9 also entered his appearance
and submitted before this Court that she
preferred an appeal before the District Teachers
Appellate Authority bearing Appeal No. 2 of
2022 for grant of salary, which has been denied
because of the irregularities committed by the
members of the Governing Body. On account of
pendency of the afore-noted appeal, the
Secretary of the District Appellate Authority has
written a letter to the Bank to keep the accounts
in question, on hold, and, as such, despite the
order passed by the Board, the operation of the
account could not be allowed to run by the newly
constituted Managing Committee.
6. Learned Advocate for the respondent nos.
7 and 8 submitted that in the entire episode the
concerned respondents have no role with respect
to the operation of the accounts. However
certain allegation has been levelled, against
them, which are vehemently refuted.
7. Having considered the submissions
advanced by the learned Advocate for the
respective parties and taking note of the fact that
there is already a decision taken by the Board
allowing the petitioner to operate the account in
question, however, because of some allegations
and dispute, the bank is facing difficulty to take
an appropriate decision. Hence, in order to
resolve the dispute once for all, this Court
directs the Secretary of the Bihar School
Examination Board to look into the matter and
take an appropriate decision forthwith respect to
operation of the bank account and communicate
the same to the Bank. It is made clear that on
receipt of the said decision/order the bank will
allow the concerned office bearer of the college
to operate the accounts, in question, forthwith. It
is expected that this exercise must be completed
within four weeks from the date/receipt of a copy
Patna High Court L.P.A No.154 of 2026 dt.26-10-2026
4/5
of this order.
8. In the meantime, the operation of the
impugned order bearing letter no. 2015/D-2025
dated 18.12.2025 shall remain stayed.”
5. Being aggrieved by the aforesaid order passed by
the learned Single Judge, the appellant, who was respondent No.
9 in the writ petition, has preferred the present intra-court
appeal.
6. Upon perusal of materials on record, it is evident
that the dispute in the present case is between the college and
the concerned Board. The appellant herein is not concerned with
the dispute, and further, no adverse order has been passed
against the appellant by the learned Single Judge. The learned
Single Judge has only directed the Secretary, Bihar School
Examination Board to look into the matter and take an
appropriate decision forthwith.
7. As such, this Court fails to understand as to how the
appellant is aggrieved by the order passed by the learned Single
Judge.
8. In view of the aforesaid, we are of the considered
opinion that the present appeal is devoid of any merit.
9. Accordingly, the present intra court appeal stands
dismissed.
10. The order of the learned Single Judge stands
Patna High Court L.P.A No.154 of 2026 dt.26-10-2026
5/5
affirmed, and the observations and directions contained therein
shall follow.
11. Pending application(s), if any, shall also stand
disposed of.
