These intra-Court appeals assail the order dated 15.9.2025
made in W.P.No.18176 of 2025, whereby the relief sought by the
appellants seeking to confer the benefit of G.O.Ms.No.49, Health and
Family Welfare (MAC-1) Department, dated 28.2.2024 came to be
rejected by the writ court.

2. Heard learned counsel for the appellants and learned
Additional Advocate General appearing for respondent Nos.1 to 15.
3. The appellants are all Super Speciality Doctors, who got
admission for the Post Graduate Super Speciality Degree Course under
the Non Service category in the respective Medical Colleges in the
State of Tamil Nadu. As per the prospectus issued for the course, the
appellants, who got admission for the Super Speciality Course in the
respective Colleges, have to compulsorily execute a bond to serve in
the Health Department for a period of two years.
4. In view of the Covid-19 situation that prevailed, based on the
orders passed earlier in the writ petition, the authorities have
undertaken the exercise of considering their request, whereby they
have issued G.O.(Ms) No.351, Health and Family Welfare (MCA-1)
Department, dated 27.10.2023 with regard to reducing the bond
period and the bond amount in respect of Non Service Post Graduates
(Degree/Diploma). The relevant portion of the G.O.(Ms) No.351,
which extended the benefits reads as follows:

“6. The Government, hereby issues the following orders
regarding the implementation of the bond requirement for
Non Service Post Graduates to Post Graduate Degree /
Diploma course in Tamil Nadu Government Medical Colleges
after carefully reviewing the request of the Director of
Medical Education and Research and the suggestions made
by the committee members:
i. The bond period for Non Service Post Graduates
(Degree/Diploma) who have completed their Post
Graduate courses in the year 2023 will be reduced
from two years to one year (from the date of joining in
the bond service) and the respective prospectus for the
Post Graduate Degree course for the academic year
2020-2021 as well as for the Diploma course for the
academic year 2021-2022 will be amended
accordingly.
ii. The bond amount for the Non Service Post
Graduates who have completed their Post Graduate
Degree courses in 2023 will be Rs.20,00,000/- only
(Twenty lakhs) instead of Rs.40,00,000/- (Forty lakhs)
and for the Non Service Post Graduates who have
completed their Post Graduate Diploma courses in
2023 will be Rs.10,00,000/- only (Ten lakhs) instead of
Rs.20,00,000/- (Twenty lakhs).
iii. Depending on the need and availability of vacancies
in the future, the Health Department henceforth will
review and consider the enforcement of 2 years bond
condition every year and issue necessary directions for
utilizing the services of the Non-service Post Graduates
in Tamil Nadu Medical Services and issue appropriate
orders.”

5. In consequence of G.O.(Ms) No.351, further order extending
benefits to the relevant candidates was issued vide G.O.(Ms) No.49,
Health and Family Welfare (MCA-1) Department, dated 28.2.2024,
whereby the bond period for Non Service Post Graduates Super
Speciality, who were admitted in the academic year 2020-2021 and
completed the course in the year 2023, was reduced from two years to
one year, and the bond amount was reduced by 50%. The relevant
portion of G.O.(Ms) No.49, reads thus:
“4. The Government after careful examination have
proposed to accept the request of the Director of Medical
Education and Research and decided to issue the following
orders:
i. The bond amount for Non Service Post Graduates
(PG Dental) who have completed their Post Graduate
course in the year 2023 onwards will be
Rs.20,00,000/- (Rupees Twenty lakh only) instead of
Rs.40,00,000/- (Rupees Forty lakhs).
ii. The bond amount for Non Service Post Graduates
(Super Speciality) who have completed their Post
Graduate Course in the year 2023 onwards will be
Rs.25,00,000/- (Rupees Twenty Five lakh only) instead
of Rs.50,00,000/- (Rupees Fifty lakh).
iii. The bond period for Non Service Post Graduates
(Dental/Super Speciality) who have completed their
Post Graduate Courses in the year 2023 onwards will
be reduced from two years to one year.

iv. The Prospectus of PG Dental and G.O.(Ms) No.462,
Health and Family Welfare Department, dated
07.11.2020 for Super Speciality Course issued for the
academic year 2020-2021 will be amended
accordingly.
v. The Services of the Non Service Post Graduates
(Dental/Super Speciality) Curses will be utilized on
Need Basis and as per vacancy anywhere in Tamil
Nadu.”
6. In the aforesaid G.O.(Ms) No.49, while the Government Order,
intended that the benefit be applicable to the Super Speciality Non
Service Post Graduates who completed the course in 2023, the word
‘ onwards ’ was inadvertently included after ‘2023’. Since this was
interpreted to mean that all Super Speciality students completing their
course in subsequent years from 2023 onwards would also be entitled
to the benefit, the State issued G.O.(Ms) No.121, Health and Family
Welfare (MCA-1) Department, dated 31.5.2024. This amendment
stipulated that the reduction of the bond period from two years to one
year applies strictly to Non Service Post Graduates (Dental/Super
Speciality) who completed their course in the year 2023. By virtue of
the amendment, it is clarified that the benefit would only be available
to the candidates who completed the course in 2023.

7. Further, a perusal of the Government Order shows that it was
issued to extend benefits to students who had joined the course in the
year 2020-2021 and completed it in 2023. While extending the benefit
of reduced bond period and bond amount, the State amended only the
relevant prospectus for the academic year 2020-2021, leaving the
prospectus for 2022-2023 unamended. Therefore, the argument that
G.O.(Ms) No.49 covers the appellants is completely misplaced.
8. The learned Single Judge, upon considering the claim raised
by the appellants on finding that G.O.(Ms) No.351 and consequential
G.O.(Ms) No.49 confer benefits exclusively on candidates who
completed the course in the year 2023, held that the appellants, who
admittedly completed the course only in 2025, are not entitled to the
benefits under G.O.(Ms) No.49 and rightly dismissed the writ petition.
9. In view of the above deliberations, we do not find any error or
infirmity in the findings arrived at by the learned Single Judge
warranting interference.

10. Accordingly, the writ appeal is dismissed. There shall be no
