ORAL ORDER

This writ petition is filed seeking the following
prayer:
i) Issue a writ of mandamus directing to the
Respondents to pay entire compensation with interest
in pursuance of 28(A) award Dtd:10.08.2010 bearing
No. /19/74-75/28(a) vide
J¯ï.J.PÀÆå/J/J¸ï.Dgï.J¸ï
Annexure-B in so far as petitioners is concerned, in the
interest of justice and equity.

ii) Issue a writ of mandamus directing the
Respondents consider the representation of the
petitioners vide Annexure-D, E, F & G and make
payment of the compensation to the petitioners as per
award Dtd:10.08.2010 vide Annexure-B passed by
Respondent No.3, in accordance with law and pay
compensation, in the interest of justice and equity.


2. Heard Sri.Harshavardhan R.Malipatil, learned
counsel appearing for the petitioners, Sri.Sanjeev Kumar
C.Patil, learned counsel appearing for the respondent
Nos.1, 2 and 4 and the learned Additional Government
Advocate appearing for the respondent No.3.


3. The petitioners are the owners of various
extents of land in Sindanoor Taluk, Raichur District. The
petitioners’ lands have been acquired for the purpose of
construction of road from Malladagudda to Virupapura via

Hosahalli. It is averred that one of the land losers sought
a reference being aggrieved by the inadequate
compensation awarded by the Land Acquisition Officer
sought for enhancement in LAC.No.27/2006 before the
Senior Civil Judge, Lingasugur. The Reference Court, vide
judgment dated 06.01.2007 enhanced the compensation
at Rs.48,500/- per acre. It is further averred that the
petitioners filed an application under Section 28A of the
Land Acquisition Act, 1894 (for short, ‘the Act’) seeking to
re-determine the compensation in their cases in terms of
judgment in LAC No.27/2006. The respondent No.3
considered the petitioners’ application, re-determined the
compensation including interest and statutory benefits and
passed the award on 10.08.2010. It is also averred that
as per the award of the respondent No.3 passed under
Section 28A of the Act, the compensation amount was re-
determined at Rs.91,65,026/-. However, the respondent
No.2 had released a part of the compensation amount to
an extent of Rs.41,47,000/- in respect of 23 cases.

Hence, the petitioners submitted representations dated
18.08.2025, 19.08.2025, 22.08.2025 and 03.09.2025
requesting to release the balance compensation amount
with interest. The same has not been considered so far.
Hence, the present petition is filed seeking to issue a writ
in the nature of mandamus.


4. The aforesaid facts indicate that the respondent
No.3 has passed the award as per judgment in LAC
No.27/2006 by determining the compensation amount.
However, the grievance of the petitioner is that the said
amount is not disbursed as per the award. I am of the
considered view that it would be appropriate to direct the
respondents to consider the petitioners’ representations
and to pass appropriate orders, if found that the
compensation is required to be paid as per the award and
then they shall make necessary payment within a
reasonable time.


5. Hence, I proceed to pass the following:

allowed
(i) The writ petition is .

(ii) A writ of mandamus is issued to the
respondents to consider the petitioner's
representations dated 18.08.2025, 19.08.2025,
22.08.2025 and 03.09.2025 at Annexures-D, E,
F, G, respectively and pay the balance
compensation amount with interest as per the
award dated 10.08.2010, if not already paid.

(iii) If the Authorities come to the conclusion that
the entire amount is paid, they shall pass an
appropriate order to that effect.

(iv) The aforesaid exercise shall be completed
within a period of 3 months from the date of
receipt of copy of the order.
No order as to costs.
