qualified, appeared in the online counselling conducted by the respondent No.-6-
University. The respondent No.6- University issued guidelines fixing the fees of
the course in question for the different periods in the following manner:-

3. The petitioners after getting qualified were allotted seats by the
respondent No.6 for admission in the aforesaid course in respondent No.8/private
institution.
4. The petitioners after getting admitted in the course in respondent
No.8/private institution tried to submit their form for scholarship by way of
online process before MPTAAS. But the aforesaid portal is showing that the
institution has not got the fee fixed from the AFRC and therefore, their data could
not be submitted before the MPTAAS.
5. The petitioners thus submitted representation (Annexure P/11) before
the Assistant Commissioner, Tribal Welfare, Gwalior raising their grievance.
However, to no avail.
6. The present petition is an outcome of inaction of the respondents in not
opening the portal of MPTAAS for submission of application forms for

receiving scholarship for the course in which they have been admitted by the

respondent No. 8/institution. However, only for the reason of inaction on the part
of the institution, i.e. respondent No.8/AFRC which is the Fee Regulatory
Committee of the State, and the respondents, they are not being permitted to fill
the form for getting scholarship. Thus, the action of the respondents is not only
contrary to the very affirmative steps taken by the State for amelioration of
conditions of the reserved category students, but is also against their own mandate
of providing scholarship to the students of reserved category.
8. The learned counsel for the petitioners submitted that it is not in the
hands of the present students that the fee be decided by the Fees Regulatory
Committee, as it is for the institution to submit the relevant documents, and it is
for the AFRC to pass order fixing the fees of respondent No.8/institution. He
further submitted that in fact, the Fees Regulatory Committee is statutorily bound
to fix the fees. Therefore, in such circumstances, the petition deserves to be
allowed.
9. In support of his submissions, he also refers to orders passed by
coordinate bench of this Court in the case of Neer Ahirwar and Ors. vs. The State
of M.P. and Ors. passed in W.P. No.12142/2023 and in the case of Shakti Singh
Rawat & Ors. vs. The State of M.P. and Ors. passed in WP No.13550/2023 on
28.08.2023.
10. Per contra, the learned counsel for the State refers to the return filed by
the respondent No. 6 and points out that only for the reason that the AFRC has not
fixed the fees for the institution i.e. the respondent No.8, thus, the MPTAAS portal
has not accepted the application forms of the present petitioners.
11. Having heard learned counsel for parties and perused the record.

in the case of Neer Ahirwar (supra) would show that earlier for the academic year

of 2021-22 and 2022-23, the State Government has opened the portal for the
students to apply for scholarship.
13. In the present case, as per the submissions made by the learned counsel
for the petitioners, there is no role of AFRC, as the course in question is regulated
by State Government, and the respondent No.6/University has already fixed the
fees for the course.
14. Considering the same, the present petition is allowed. The respondents
are directed to open the portal of MPTAAS so as to enable the petitioners to
submit their applications for grant of scholarship within a period of one month
from the date of communication of this order, and the process be completed in
accordance with law.
15. With the aforesaid, the petition stands allowed.
C.C. as per rules.
