O R D E R (Oral):-
Per: Justice Sunil Thomas, Judicial Member
When the matter was taken up, the learned Standing Counsel
submitted that the arrears of pension has been paid to the applicant. After
verification, the learned Counsel for the applicant also acknowledged the
payment, though belatedly. Hence, the learned Counsel contended that
since there was no delay attributable to the applicant, she is entitled for
interest on the delayed payment. Though the learned Standing Counsel
objected and stated that due to administration reasons there was some delay
in giving the benefits of next Pay Commission, we feel that it is in the
interest of justice that the applicant is paid the interest on the differential
amount.
2. Accordingly, we are inclined to dispose of the Original Application
with a direction to the respondents that on the entire arrears due for the
periond during which the pension was not paid, and wherever less pension
was paid, on the differential amount, the interest shall be paid at GPF rate,
within a period of two months from the date of receipt of copy of this order.
If the amount is not paid within the time stipulated, the right of the applicant
to seek implementation of the order is also reserved.

3. With the above direction, the O.A is disposed of. No costs.
