and the present petitioner, based on the first information
dated 04.04.2026 received from Ranjitha wife of Dilip
Kumar who is the aunt of CW12/Smt. Rakshitha, wife of
Vijay, who is the deceased in the present case.
4. During the course of investigation, petitioner who
is arrayed as accused No.2 in the FIR was arrested on
04.04.2026 and remanded to judicial custody. The charge
sheet is now filed against two persons and petitioner is
arrayed as accused No.2 in the charge sheet. His younger
brother is arrayed as accused No.1 in the charge sheet.
The bail application filed by the petitioner before the Trial
Court in Crl.Misc.No.7990/2026 was rejected on
29.08.2026. Therefore, he is before this court.
5. In the first information submitted by Smt.
Ranjitha / CW1, it is stated that on 03.04.2026, Vijay and
his wife Rakshitha had come to their house at about 10:00
p.m. and Vijay had consumed excess alcohol and therefore

with his wife and went away. It is alleged that Vijay
thereafter threw a stone on the two wheeler of the

who allegedly locked himself inside the house of CW1.
Accused Nos.1 and 2 had thereafter left the spot, after
threatening Vijay with dire consequences.
6. On 04.04.2026, Vijay had borrowed a sum of

the accused persons had assaulted Vijay with a knife for
the reason that he had spoken ill about the girlfriend of
accused no.1 and her mother and also for the reason that
Vijay had damaged their bike, on the earlier night.
Immediately, thereafter CW1 went to the hospital and
found the dead body of Vijay and thereafter approached

the police and FIR was registered against accused no. 1
and 2 in the present case.
7. The CW28/Mohammed Hafiz is said to be the
eyewitness to the incident in question. His statement was
recorded on 22.04.2026 and this witness has clearly
stated that he had seen 2 persons restraining deceased
Vijay and one among them, who was armed with knife had
stabbed Vijay with the said weapon. Thereafter, both the
accused persons had escaped from the spot of crime. This
statement of CW28, corroborates with the statement of
CW6, who allegedly was informed over phone about the
assault made by accused Nos.1 and 2 on Vijay with a
knife. Accused No.1 has confessed that he had assaulted
Vijay with a knife on 04.04.2026 and even the weapon
used to commit the crime has been recovered and seized
at the instance of accused no.1. From the aforesaid it
appears that accused no.1 had stabbed Vijay and accused
no.2 who is the elder brother of accused no.1 was present
at the spot of crime, but no specific overt acts are found

8. Learned counsel for the petitioner has submitted
that the petitioner is a person with no criminal
antecedents. Investigation of the case is now completed.
Allegations found in the charge sheet are required to be
proved in a full fledged trial. Under the circumstances , I
am of the opinion that the prayer made by the petitioner
for grant of regular bail needs to be answered
affirmatively. Accordingly, the following:
