IPC.

2. Brief facts giving rise to filing of this appeal are as
under:
One Amannullah Khan S/o Jafar Khan, lodged a
complaint before the police on 06.02.2011, wherein it
is alleged that accused No.1 i.e., respondent No.1

constructed their respective houses and were residing
therein. However, accused No.1 claimed himself that
those plots were purchased by him and threatened
that in case they did not vacate from the plots, he will
demolish the houses constructed on the said plots
through JCB and take over the possession of the
same. Such being the case, on 06.02.2011 at 08:00

brought JCB along with 6 to 7 persons in the

the said houses, even though, he had purchased the
same, therefore, he was taking the JCB for
demolishing the said houses. It is further alleged that
when Mohammad Siddiqui and others came to the
place of occurrence, accused No.1 abused them in
filthy language so as to murder Mohammad Siddiqui
and others, as accused No.1 abetted the driver of JCB
i.e. accused No.2 who has driven the JCB vehicle

There is a delay of more than 1 month in recording

others, wherein the complainant and others were

been given a criminal colour by the complainant to

22. The scope of interfering in the order of acquittal is
very limited, in view of the proposition laid down by
the Hon'ble Apex Court in the case of Jafarudheen
(supra) , wherein the Hon'ble Apex Court held at para-
25 as follows:
“25. While dealing with an appeal against the
acquittal by invoking Section 378 of Cr.P.C., the
Appellate Court has to consider whether the Trial
Court's view can be termed as a possible one,
particularly when the evidence on record has been
analyzed. The reason is that an order of acquittal
adds up to the presumption of innocence in favour of
the accused. Thus, the Appellate Court has to be
relatively slow in reversing the order of Trial Court
rendering acquittal. Therefore, the presumption in
favour of the accused does not get weakened but
only strengthened. Such a double presumption that
enures in favour of the accused has to be disturbed
only through scrutiny on accepted legal parameters.”
