expressed their view that only an extent of 166 acres 19
guntas be declared as excess of land. Accordingly, the
impugned order has been passed.
7. Learned counsel for the petitioners submits that the said
finding arrived at by the Land Tribunal is erroneous

portion of the land by the petitioners constraining them to
file a suit for permanent injunction.
8. That respondent Nos.6 to 10 have also filed a suit seeking
permanent injunction against some of the petitioners. That
even according to the inspection report, 111 persons
including the petitioners are cultivating the land measuring
231 acres, which has not been taken into consideration by
the Land Tribunal. Hence, seeks for allowing of the

9. Learned counsel appearing for the respondent Nos.6 to 10
on the other hand submits that the suit filed by the
petitioners seeking declaration of their rights based on
adverse possession has been dismissed. He further
submits that the order passed by the Land Tribunal is
based on the inspection report and the factual aspect of
the matter. That the reason assigned by the Land Tribunal
stating that 423 acres 39 guntas of land not being
cultivable classified as a `kharab land' capable of being

Therefore, seeks for dismissal of the petitions.
10. Learned AGA submits that the matter requires
reconsideration inasmuch as the Land Tribunal has sought
to allot/return the kharab land to the landowners which is
impermissible. Therefore he seeks for setting aside of the
order.
11. Heard and perused the records.
12. There is no dispute of the fact that in terms of the order
dated 29.03.1976 produced at Annexure-A, upon an
application filed on behalf of respondent Nos.6 to 13, an
order came to be passed holding that the aforesaid land to
an extent of 590 acres 18 guntas was excess holding and
the same was resumed to the Government. Challenge to

earlier two occasions by filing writ petitions in

13. The Chairman of the Land Tribunal relying upon the
purported report and the spot inspection obtained has
found that out of 590 acres 18 guntas, only 292 acres
19 guntas could be held as non-cultivable and excess,
while in the remainder of land there are already people
who are cultivating the lands. However, the other
members of the Land Tribunal have found only an extent
of 166 acres 19 guntas could be held as cultivable and
excess and the remaining extent of 423 acres 39 guntas
which is uncultivable and kharab land cannot be held as
excess and returned back to the owners. This does not
meet the requirement of law as pointed out by the learned
counsel of the petitioners.

C/W WP No. 101865 of 2025

14. The order of the Land Tribunal does not indicate whether
or not a proper enquiry was conducted regarding the
cultivable nature of the land.
15. There is no basis on which the Chairman has found an
extent of 292 acres 19 guntas out of 590 acres to be
uncultivable whereas other member have found only 166
acres 19 guntas to be uncultivable. There is also no
specific details as to who are in occupation of land and to
what extent.
16. The conflicting view of the Chairman and of the members
on the very same report is unjustifiable and unsustainable.
17. Fact remains 590 acres 18 guntas of land was declared to
be excess as far back as on 27.03.1976 and the matter is
still not concluded. Land Tribunal ought to have been
cautious about the provisions of law and its responsibilities
instead of dealing with the matter of this nature in such a
casual manner without reference to the provisions of law.

C/W WP No. 101865 of 2025

18. It is also not in dispute in the meanwhile even as
emanating from the impugned order rights have been
created in favour of several cultivators and the petitioners
also claim to be in possession of this so called excess land
of 290 acres. This has further led to the filing of suits and
counter suit by the parties. If the Land Tribunal had
adjudicated the matter in the manner known to law,
situation of this nature would not have arose.
19. Nonetheless, as submitted by learned AGA, the matter
requires to be remitted to the Land Tribunal as there are
no sufficient material placed on record with regard to the
nature of the land, whether cultivable or not, and to the
extent of land cultivable, which are factual aspects of the
matter requiring consideration at the hands of the Land
Tribunal.
