Order on Board
28/10/2026
1. By the present writ petition, the petitioner seeks a direction to the
respondent authorities to consider his case for posting as Lecturer
in a Government Higher Secondary School in accordance with the
counselling guidelines dated 08.09.2025 (Annexure P/2) and the
applicable rules.
2. Learned counsel appearing for the petitioner submits that the
petitioner, while working as Teacher (LB), T-Cadre, was promoted
to the post of Lecturer (Physics) vide promotion order dated
22.07.2025 (Annexure P/1), and counselling was scheduled to be
held on 26.09.2025. He submits that Government Higher
Secondary School, Kansinghi, Block Chhura, District Gariaband,
is situated within the same campus as the institution where the
petitioner was already serving and that a post of Lecturer
(Physics) was available in the said school. He submits that,
despite submitting a representation dated 25.09.2025 seeking
consideration for posting against the said post, no decision was
3
communicated to him before counselling. Although the petitioner
declined to accept the promotion during the counselling held on
26.09.2025, he is now willing to accept posting against any
vacancy remaining after the counselling process. He, therefore,
prays that the respondent authorities be directed to consider his
case and by referring to Clause H of the counselling guidelines,
he submits that the petitioner is entitled to be considered for
posting against the remaining vacancies available after
completion of the counselling process.
3. On the other hand, learned State counsel submits that though the
petitioner has sought posting at Government Higher Secondary
School, Kanjingi, Block Churaha, District Gariyaband, the same
cannot be granted, as the petitioner himself declined to participate
in the counselling process. However, learned counsel submits
that, since the petitioner is now willing to accept posting against
any vacancy remaining unfilled after counselling, his claim shall
be considered and an appropriate posting order shall be passed in
accordance with Clause H of the counselling guidelines (Annexure
P/2).
4. I have heard learned counsel for the parties and perused the
pleadings as well as the documents appended to the writ petition.
5. Considering the limited prayer made by learned counsel for the
petitioner and taking into account the submission made by learned
State counsel, this writ petition is disposed of with a direction to
4
the respondent authorities to consider the petitioner’s case for
posting to the promotional post of Lecturer against a vacancy
remaining unfilled after completion of the counselling process, in
accordance with Clause H of the counselling guidelines dated
08.09.2025 (Annexure P/2), and issue an appropriate posting
order within a period of 30 days from the date of production of a
copy of this order before the Director of Public Instructions (DPI).
6. The petitioner shall be at liberty to submit a copy of this order
before the Director of Public Instructions for necessary
compliance.
7. With the aforesaid direction, the writ petition is disposed of .
