hearing meeting. No documents have been

been decided that the project of M/s Sat
Chikitsa Prasarak Mandal Yavatmal, Distt.
Yavatmal be terminated immediately and
PIA be blacklisted from working with
BRLPS (JEEViKA) for a period of 3 years
with immediate effect.”
4. Suffice to state that insofar as the plea of the
learned counsel for the petitioner that no show-cause notice was
issued to the petitioner is concerned, letter dated 26.05.2025,
Patna High Court CWJC No.12196 of 2026 dt.03-11-2026
9/11
vide last Paragraph (Page 50) reads as under :-
“You are hereby required to
confirm your presence for the above
mentioned date within 05 days of receipt of
this letter. Failing which recovery of
project advance and applicable interest
through certificate case under “Public
Demand Recovery Act” will be initiated.
Other actions including blacklisting will
also be initiated in the light of MOU,
Guidelines, SOP and Notifications of DDU
GKY, Ministry of Rural Development,
Govt. of India.
Looking forward to close the
project on priority as it involves public
fund and PIA owes a responsibility to settle
the account on priority.”
5. The above is a show-cause notice issued to the
petitioner, including on the aspect of blacklisting.
6. The petitioner had appeared before the CEO, to
represent its case, on 06.06.2025. It is pursuant thereto that the
impugned order has been passed.
7. The submission of the learned counsel for the
petitioner is primarily by drawing our attention to the page-50 of
the notice to contend that the requirement of hearing would not
substitute a show-cause notice.
8. We are unable to accept this plea of the learned
counsel for the petitioner in view of the facts noted by us in the
aforesaid paragraphs. It is a case where the respondent-BRLPS
Patna High Court CWJC No.12196 of 2026 dt.03-11-2026
10/11
has been writing to the petitioner from time to time notifying the
non-performance of obligations by the petitioner in terms of the
MoU as executed. In fact, on some occasions notices of penalty
were also issued to the petitioner.
9. We agree with the submission of Mr. Abhinav
Shrivastava, learned Senior counsel for the respondents that the
notices relate back to the year 2018, hence in that sense it is
immediately after the execution of the MoU, the petitioner
started defaulting in performing its obligations under the MoU.
Vide communication dated 26.05.2025, the respondent-BRLPS
has expressed itself its intention to take action for blacklisting
the petitioner in the light of the MoU, Guidelines, SOP and
notifications of DDU-GKY, Ministry of Rural Development,
Government of India. Hence the plea that no show-cause was
issued is liable to be rejected.
10. One of the pleas of the learned counsel for the
petitioner is also on the proportionality of the impugned action
inasmuch as the petitioner has been blacklisted for a period of
three years, which is impermissible.
11. We are unable to accept the said plea of the
learned counsel for the petitioner more particularly in view of
the facts noted by us in the aforesaid paragraphs. It is not a case
Patna High Court CWJC No.12196 of 2026 dt.03-11-2026
11/11
that blacklisting of three years shocks the conscience of the
Court. Even the scope of judicial review at least in the facts of
this case cannot be exercised, more particularly in exercise of
our jurisdiction under Article 226 of the Constitution of India.
12. We are of the view that the present petition lacks
merit and the same is liable to be dismissed. We order
accordingly.
13. Pending application(s), if any, shall also stand
disposed of.
