THESE PETITIONS, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY
ORAL ORDER
Accused Nos.1, 3 and 4 in Crime No.86/2026

before this Court in these two petitions filed under Section

seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.86/2026 was registered by
Yagati Police Station, Chikkamagaluru, for the aforesaid

arrested on 01.08.2026 and accused No.3 was arrested on
07.08.2026. Subsequently, they were remanded to the
judicial custody. Their bail application filed before the
jurisdictional Sessions Court in Crl.Misc.No.531/2026 and
Crl.Misc.No.534/2026 was rejected vide order dated
31.08.2026. Therefore, they are before this Court.
4. A reading of the first information submitted in
the present case as well as the material made available to
this Court would go to show that the family of the accused
and the family of deceased Kariyappa had some dispute
between them and they had earlier quarreled with each
other. On the morning of 26.07.2026 Kariyappa was not
found in his house and therefore, his family members had
searched for him and in the CCTV camera installed near
Balaji club, it was seen that deceased Kariyappa had gone
towards the property of the accused persons on the night
of 25.07.2026 and thereafter he had not returned back.
Thereafter, when the accused persons were questioned,

they allegedly stated that they had committed the murder
of Kariyappa and had buried his dead body. It is under
these circumstances, FIR was registered against the
petitioners and others.
5. The remand application of the accused persons
and other material made available to this Court would
reveal that on the night of 25.07.2026, Kariyappa, who
had gone towards the property of the accused persons,
accidently came in contact with the live electricity wire,
which accused Nos.1 and 2 had drawn in their property for
preventing wild animals from entering their agricultural
land. After coming into contact with the live electric wire,
Kariyappa died at the spot. It appears that accused
persons, who came to know about the same, thereafter in
a hurried manner, buried the dead body of deceased
Kariyappa.

6. During the course of investigation, the dead
body of deceased Kariyappa was exhumed and the post
mortem report of the deceased Kariyappa would go to
show that death was due to electrocution and there was
no other external injuries found on his body. Major portion
of the investigation is completed and the petitioners, who
are agriculturists by avocation, are in custody. Under the
circumstances, I am of the opinion that their prayer for
grant of regular bail needs to be answered in the
affirmative. Accordingly, the following:
