For Non-applicant : Ms. Laxmeen Kashyap, P.L.
Hon’ble Shri Justice Rakesh Mohan Pandey
Order on Board
04.11.2026
1. This is the first bail application filed under Section 483 of the
Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail
to the applicants who have been arrested in connection with
Crime No. 70/2026 registered at Police Station Singhora, District
2
Mahasamund (C.G.), for the offence punishable under Section
20(B) of the N.D.P.S. Act against the present applicants.
2. Case of the prosecution, in brief, is that Police Station Singhora
received secret information regarding illegal transportation of
ganja. On the basis of such information, the police intercepted a
HONDA AMAZE car bearing registration No. MH 34 AM 7642 and
seized 9 kg of ganja from the possession of the present
applicants. Thereafter, the aforesaid case was registered against
the present applicants.
3. Learned counsel for the applicants submits that the applicants
have been falsely implicated in the present case and the
contraband article was not seized from their exclusive and
conscious possession. He further submits that the applicants
Shahid Khan and Rohit Keshkar have no criminal antecedents,
while applicant Shubham Keshkar has 07 prior cases which are
not of a similar nature and 06 cases have been disposed of. He
contends that the charge-sheet has been filed, the contraband
article is less than commercial quantity, and the applicants have
been languishing in jail since 29.06.2026. He further contends that
the conclusion of trial is likely to take time; therefore, the instant
bail application may kindly be allowed.
4. On the other hand, learned counsel for the State opposes the bail
applications and submits that the applicants were actively
involved in the illegal transportation of the contraband article, i.e.,
3
ganja. She further submits that one of the applicants has 07
criminal antecedents; therefore, the applicants are not entitled to
be enlarged on bail.
5. I have heard learned counsel appearing for the parties and
perused the case diary.
6. It appears that the contraband article, i.e., 9 kg of ganja, was
recovered from the joint possession of the applicants, which is
less than commercial quantity. Moreover, the applicants Shahid
Khan and Rohit Keshkar have no criminal antecedents, while
applicant Shubham Keshkar has 07 criminal antecedents which
are not of a similar nature and 06 cases have been disposed of.
Further, considering that the charge-sheet has already been filed
before the competent court, the applicants have been in judicial
custody since 29.06.2026, and the conclusion of the trial is likely
to take time, this Court is of the view that the applicants are
entitled to be released on bail.
7. It is directed that in the event of the applicants executing a
personal bond for a sum of Rs. 50,000/- to the satisfaction of the
concerned trial Court, they shall be released on bail on the
following conditions:-
(a) they shall make themselves available for
interrogation by the police officer as and when
required;
(b)they shall not directly or indirectly make any
inducement, threat or promise to any person
4
acquainted with the facts of the case so as to
dissuade him from disclosing such fact to the
Court; and
(c) they shall not act in any manner which will be
prejudicial to a fair and expeditious trial.
The observation made hereinabove is for the purpose of
deciding this bail application only, the learned trial Court shall
decide the case on its own merits.
