Dilbagh Singh --Applicant
Versus
State Of Uttarakhand
--Respondent

Hon’ble Siddhartha Sah, J.

Mr. Harshit Sanwal, learned counsel for the

applicant.
2. Mr. Pratirup Pandey, learned Assistant
Government Advocate for the State.
3. Mr. S. K. Mandal, learned counsel for the
informant.
4. By means of the present Time Extension
Application (MCRC No.01 of 2026) in Short Term Bail
Application No.12 of 2026, the applicant has sought
extension of the period of short-term bail granted vide
order dated 24.09.2026 for a period of four weeks.
5. Learned counsel for the applicant would submit
that vide order dated 24.09.2026 the applicant was
enlarged on short-term bail for a period of 4 weeks
from the date of his actual release on account of
proposed coronary angiography. In the application for
extension of short-term bail, the applicant has stated
that pursuant to the order dated 24.09.2026, the
applicant was released from custody on 25.09.2026.
6. On 01.10.2026, the applicant reported
symptoms of chest pain, shortness of breath, and
body ache and had to be taken to State Medical
College, Pandit Ram Prasad Bismil Hospital,
Shahjahanpur, Government Hospital near his

residence.
7. At the time of discharge, the hospital
specifically advised that his angiography be done at
another centre. According to the advice of this
hospital, the family members of the applicant took
him to the Medicity Hospital, Rudrapur, District
Udham Singh Nagar where he was examined by a
heart specialist (cardiologist).
8. On 12.10.2026, doctor advised the applicant to
undergo an ECG and blood test. The ECG again
shows an irregular heartbeat. The blood test shows
that his diabetes is not under control.
9. On 13.10.2026, the applicant underwent an
ultrasound of the heart (echocardiography), which
showed a mild weakness in the relaxing function of
the heart muscle (grade I diastolic dysfunction). On
the same day, he underwent a treadmill (stress) test
and the doctor recorded that the test was positive. i.e.
his heart muscle was not getting blood, but when put
under strain, it indicated blockages in arteries
supplying blood to the heart.
10. In view of the above, the applicant was admitted
to the hospital on 13.10.2026 and a coronary
angiography was performed on him on the same day
to find out whether and how much the arteries are
blocked. The report dated 13.10.2026 shows that
three of the main arteries supplying blood to the
applicant's heart along with one more branch artery,
are seriously blocked to the extent of 70% to 90%. In
medical terms, this is described as “triple-vessel
disease”. The most serious blockage is 90% and two
other arteries are 80% blocked. The doctor has
recommended angioplasty of several arteries. The
doctor has specifically recommended that the
applicant be admitted to the hospital on 23.10.2026
for angioplasty of several arteries. Until then, the

applicant has been kept on medicines and has been
told to rush to the hospital immediately if he suffers
chest pain, common breathlessness, sweating,
common giddiness, or similar symptoms. Copies of
the medical reports have been placed on record as
annexure no.2 to the application.
11. It is further mentioned in the time extension
application that the very date fixed by the doctor for
performing angioplasty, i.e. 23.10.2026, is the same
date on which the period of short-term bail granted to
the applicant expires, and on which he would
otherwise have to surrender before the court
concerned. Unless the period of short-term bail is
extended, the applicant would be forced to give up the
very treatment that his coronary angiography, for
which the Hon’ble Court had granted him short term
bail, has shown to be necessary.
12. It is further stated in the aforesaid application
that, considering the serious blockages now found in
his heart, the applicant’s age of about 73 years, his
uncontrolled diabetes, irregular heartbeat, and
anaemia, any further delay could seriously affect his
heart.
13. The applicant is therefore seeking extension of
the period of short-term bail granted vide order dated
24.09.2026 by a further period of two weeks, only
from the expiry on 23.10.2026 so that he can undergo
the necessary angioplasty surgery as scheduled on
23.10.2026, and to receive the necessary care and
follow-up immediately after it.
14. The applicant undertakes to surrender before
the court concerned on or before the expiry of the
extended period.
15. Mr. S.K. Mandal, learned counsel for the
informant, has opposed the short-term extension
application on the premise that his ecocardiography

report is normal. However, he would not dispute that
angiography has been recommended. Angiography
has taken place, after which angioplasty has been
recommended.
16. Considering that the short-term bail granted to
the applicant will be expiring on 23.10.2026, on
which date he has to report for admission in the
hospital to undergo angioplasty, and also considering
that if the time extension application is not allowed,
there may be threat to his life in case there is no
immediate medical attention given to the applicant,
the objections, which have been raised by the learned
counsel for the informant deserves to be ignored.
17. Thus, in view of the immediate medical
requirement for undergoing the angioplasty, for which
the applicant needs to be admitted to the hospital on
23.10.2026, and on humanitarian grounds, it is
provided that the short-term bail which has been
granted to the applicant on 24.09.2026 is extended
for a further period of two weeks only from the expiry
on 23.10.2026.
18. It is made clear that on the expiry of the
extended period of two weeks, the applicant shall
surrender before the court concerned, and intimation
to that effect shall also be given to this court.
19. With the aforesaid observations, the Time
Extension Application (MCRC No.01 of 2026) for
short-term bail is disposed of.
