ORAL ORDER
1. The petitioners, claiming to be the absolute owners in
possession of the lands bearing Sy. No. 217/11,
measuring 20 guntas; Sy. No. 217/6, measuring 20
guntas; Sy. No. 217/10, measuring 10 guntas; and Sy.
No. 217/12, measuring 20 guntas, are before this Court
seeking the following reliefs:
“a) Issue Writ of Mandamus or any other appropriate
writ, order or direction and thereby directing the
Respondent authorities to reconsider the objections
filed by the Petitioners and to deviate the alignment
of the Nala from the middle portion of the Petitioner's
land to the western side of the land, so that the
remaining portion of land is left in a useful and
cultivable condition,
b) Direct the Respondent authorities to prepare a
revised map accordingly, in a fair and scientific
manner, after considering the Petitioner's objections
and representations,
c) Issue a Writ of Certiorari or any other appropriate

produced at Annexure-B,
d) Pass such other order or direction as this Hon'ble

notified for acquisition under Section 11(1) of the Right to
Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013, for the
purpose of construction of Kerodi Nala in Unit No. 3 of
Navanagar. The petitioners had filed objections before the
Special Land Acquisition Officer of the respondent-
Authority, requesting that the acquisition be confined to
one side (the western portion) of the land, as the
proposed map indicates that the land sought to be
acquired passes through the middle portion of the land
belonging to the petitioners. According to the petitioners,
such acquisition would result in bifurcation of the land
and render the remaining extent unfit for cultivation or
development. They, therefore, sought realignment of the
proposed nala.
3. A reply dated 19.03.2025 was issued by the Special Land
Acquisition Officer of the respondent-Authority, rejecting
the request of the petitioners. Being aggrieved, the
petitioners have approached this Court.

4. Learned counsel for the petitioners, taking this Court
through the records, submits that if the alignment of the
proposed nala is shifted as indicated in the sketches
produced as Annexures-C and F, the purpose of the
petition would be served. It is submitted that such
realignment would not cause any hindrance to the
respondents in proceeding with the proposed construction
of the nala and, at the same time, would ensure that the
utility of the petitioners’ land is not diminished.
5. In response, learned counsel appearing for the
respondent-Authority draws the attention of this Court to
the village map produced as an annexure and points out
that the proposed construction of the nala follows its
natural course of flow, which runs through lands bearing
Sy. Nos. 216, 217, 218 and 219. The middle portion of
the nala falls within Sy. No. 217, which is claimed by the
petitioners.
6. Learned counsel submits that the alignment of the nala
cannot be altered in the manner sought by the
petitioners, inasmuch as the construction of the nala upto

the boundaries adjoining Sy. Nos. 216 and 218 has
already been completed, and only the construction across
the land in Sy. No. 217, which is the subject matter of
the present petition, remains pending. Learned counsel
also refers to the photographs produced along with the
statement of objections, which indicate that the
construction of the nala has been completed up to the
boundaries of the petitioners’ property on either side.
7. Annexure-G3 is the communication dated 19.03.2025
issued by the Assistant Executive Engineer of the
respondent-Authority, which reads as under:

The sketches produced by the petitioners as Annexures-C and F
indicate a deviation of the nala at the land belonging to the
petitioners. The request of the petitioners would, in effect,
amount to a deviation from the natural course of flow of the
nala. The authorities have found the request of the petitioners
for realignment to be impractical and unscientific. Besides, the
construction having already been completed up to the
boundaries of the petitioners’ property on either side, this Court
