CORAM: HON'BLE MR. JUSTICE M.G.S. KAMAL

ORAL ORDER

1. Petitioners claiming to be the allottees of residential site
measuring 30X40 feet forming part of land bearing
Sy.No.34 originally belonging to one Abdul Karim son of
Abdul Ghani Morab, purportedly allotted by respondent
No.6 by way of gift in the year 1998 are before this Court
seeking following reliefs.
“A] A writ in the nature of certiorari to quash
impugned endorsement dated 23-12-2015
rd
issued by the 3 respondent under
no.LND/CR/280+281/2014-15 vide ANNEXURE-
N.

st
B] A writ in the nature of mandamus direct the 1
respondent to consider the representation dated
8-11-2010 vide ANNEXURE-J and to allot the
sites to the petitioners and pay the
compensation/ damages for the loss suffered by
the petitioners.

C] Any other writ or direction from this Hon'ble
Court deems fit under the facts and
circumstances of the case, in the interest of
justice.”

2. Learned counsel for the petitioners submits that originally
the said land belonged to one Abdul Karim who had
formed a layout and sold and conveyed sites therein.
Some of the beneficiary of such conveyance and sale are

the petitioners herein. That the land bearing Sy.Nos.50,
53, 40, 39, 46, 41, 42, 33 and 34, which also consists of
the plots belonged to the petitioners was acquired by the
erstwhile University of Agriculture Science, Bengaluru, for
the development of its campus at Dharwad. The said
acquisition was challenged in W.P.Nos.21205-
21216/1986, which were dismissed. The said order was
confirmed by the Division Bench and thereafter by the
Supreme Court.

3. However, in the year 1997, respondent No.1 de-notified
certain portion of the acquired land and had called upon
the remaining owners to hand over the possession. This
has given rise to one more round of litigation by filing writ
petitions in W.P.Nos.15882-15886/1999 and
W.P.Nos.11492-11537-39/1999. The said writ petitions
were dismissed. However, liberty was reserved to the
landowners to approach the Government by way of
representation within 2 weeks with further direction to the
State Government to consider the representation in
accordance with law.

4. That as per the said directions, respondent No.1 had
considered representation and dropped the acquisition
proceedings in respect of lands in Sy.Nos.41 and 42 of
Saidapur village, Dharwad. In furtherance whereof allotted
sites measuring 30X40 feet were allotted only to 31
members of respondent No.6-Sangha, but did not allot
such sites to the petitioners herein. Respondent No.2 had
issued notices to persons including present petitioner
directing them to appear before him on 02.05.2002 for
consideration of the representation. Accordingly they
appeared. No steps were taken by the respondent No.2 till
date. However, communication was addressed by
respondent No.2 to respondent No.3 who, without any spot
inspection and without holding any enquiry, submitted a
report to the respondent No.2 stating that the said sites
measuring 30X40 feet had already been allotted to 31
members and there are no sites available in the land. The
said report submitted by respondent No.3 was forwarded
by respondent No.2 to respondent No.1 for necessary steps
and the matter is still pending before respondent No.1.

WP No. 107854 of 2016

CNR: KAHC020021512016

5. Thus, learned counsel for the petitioner reiterating the
aforesaid facts submits that when the matter is still
pending consideration before respondent No.1/State,
respondent No.3 could not have premeditated the matter
and issued the impugned communication rejecting the
request of the petitioners. He further submits that the
Deputy Commissioner had conducted spot inspection and
had even recommended to the State to allot the sites to
the petitioners. Even the said recommendation is not taken
into consideration by respondent No.3. Therefore he
submits that respondent No.3 apart from not having
jurisdiction to decide the representation which was being
considered by respondent No.1-State, ought not to have
rejected the same. Hence seeks for allowing of the petition
by issuing writ of certiorari and mandamus as sought for.

6. Learned Additional Government Advocate along with Sri
Ramachandra A Mali, learned counsel appearing for
respondent No.5-University submits that acquisition of the
subject lands has attained finality, and has been in
possession of respondent No.5-Uniersity. That there are no

sites to be allotted to the petitioners as sought for. Hence,
seek for rejection of writ petition.

7. Heard and perused the records.

8. Admittedly the possession of the land has been handed
over to beneficiary of the acquisition namely respondent
No.5-University. Petitioners were neither the allottees nor
have any right, title or interest over the said acquired land.
Their claim over the land is unsubstantiated.

9. The Deputy Commissioner-respondent No.2 has submitted
the detailed report to the State with regard to the
representation made by the petitioners and has come to
the conclusion that the lands having been acquired and
possession having been delivered as far back as
01.04.1999. That apart, the erstwhile owner of the land,
Abdul son of Abdul Ghani Morab, already having received
enhanced compensation, no subsisting right is left with the
acquired land. Under these circumstances, the claim of the
petitioners of they having right, title and interest over the
sites purportedly allotted to them was not justified.

was not appropriate to entertain the request for revising
the decision.

12. Thus there is no recommendation by the Deputy
Commissioner as sought to be contended by learned
counsel for the petitioners for allotment of sites in favour

was submitted by the Deputy Commissioner in the report.
It only clarifies that even the site which was allotted to 31
