the extent directing the Chief Executive Officer of Mylara
Lingeshwara Swamy Temple to conduct enquiry pursuant
to the report dated 24.11.2024 and to submit a report
thereon on or before 31.03.2025.
3. Writ Petition in W.P.No.106994/2025 is by petitioners
therein who claim to be the family members of Hereditary
Trustee being aggrieved by the Official Memorandum dated
22.12.2024 issued by Deputy Commissioner imposing
restrictions for entry into the Garbhagudi.
4. These three writ petitions give rise to common question
with regard to the power and authority of respondent
No.1-Deputy Commissioner and respondent No.3-Chief
Executive Officer to issue such Official Memorandum and
the report. The same are taken up for analogous hearing
and disposal.
5. Heard learned Senior counsel, Sri Harish Narasappa for

6. Learned Senior counsel appearing for the petitioner at the
outset pointed out provisions of sub-section (1) of Section
25A and Section 58 of the Karnataka Hindu Religious
Institutions and Charitable Endowments Act, 1997
(hereinafter referred to as ‘Act, 1997’) to contend that in
respect of Institutions managed by Hereditary Trustees,
there shall not be any committee other than the Hereditary
Trustees and that the power of Management shall rest
absolutely with the Hereditary Trustee without any
intervention from anyone whomsoever and that Section 58
of the Act, 1997 mandates that the Deputy Commissioner,
Assistant Commissioner and every other person exercising
the power under the Act shall not interfere with the
customs, usages, ceremonies and practices which are
being followed in respect of such notified Institutions.
7. Juxtaposing this mandate of the provisions of law, learned
Senior counsel reads into the impugned Official
Memorandum, which is subject matter of Writ Petition in
W.P.No.103119/2025 as well as W.P.No.106994/2025 and
submits that without even mentioning the provisions of law

under which respondent No.1-Deputy Commissioner
purportedly exercising power, alleged violation of customs
in the Institution consequently leading to impugned
direction, not to allow anyone else other than the
appointed Archaka, into the Garbhagudi of the Temple.
8. He submits once concededly petitioner No.2 is appointed
as the Hereditary Trustee, it is his prerogative to ensure
maintenance of the usage, practices and respondent No.3-
Chief Executive Officer particularly has no say in the
matter. That the impugned Official Memorandum has
emanated apparently at the instance of respondent No.3-
Executive Officer, who again without any basis has alleged
violation of the practices of the Temple. No enquiry has
been conducted for the respondent No.3-Executive Officer
to have issued such a report.
9. He further refers to show-cause notice dated 24.11.2024
issued by respondent No.3-Chief Executive Officer to
contend that respondent No.3-Executive Officer has no
statutory power to issue such notice calling upon the

10. He also refers to undated show-cause notice produced at
Annexure-E purportedly issued by respondent No.1-Deputy
Commissioner, who has merely reiterated the contents of
purported report dated 24.11.2024 issued by respondent
No.3-Executive Officer with a purported addition therein
with regard to money being collected through money
order, EMO and Google Pay, which according to learned
Senior counsel is an addition in the process of malafide
exercise of administrative power to build up a case against
the petitioners.
11. He referred to a judgment dated 12.08.1933 passed in
O.S.No.36/1929 on the file of District Judge, Ballari with
regard to an issue which had then cropped up relating to
administrative affairs and the scheme of management of

of the plaintiff therein, who is grandfather of petitioner
No.2 herein.
12. Thus, he submits the impugned Official Memorandum at
Annexure-A requires to be quashed.
13. As regards W.P.No.102900/2025, he submits that the
proceedings subject matter of the said writ petition
emanate from an order passed by respondent No.1-Deputy
Commissioner in exercise of his power under Section
25(B)(6)(iii) of Act, 1997, in terms of which respondent
No.1-Deputy Commissioner accepting the case of one

14. He submits that the grievance of the petitioner in the said
writ petition is to the second part of the order in which the
Deputy Commissioner apart from exceeding the brief has

report dated 24.11.2024 (Annexure-B in Writ Petition

Deputy Commissioner or with the Chief Executive Officer to
conduct such an enquiry is his submission.
15. As regards Writ Petition in W.P.No.106994/2025, the
petitioners therein claim to be the family members of
Hereditary Trustees. It is their contention that they have
been traditionally practicing and performing rituals such as
Bandara Darshana, Chowri, Chadu, Kaaye Kolu, Yele
Chanchi, Yele Kathari, Gorvayaka Kori, Angi Dhoni, Kavadi
and Chaapi, etc., which has been in existence since time
immemorial and that the same has been recognized in the
judgment and decree that was passed in O.S.No.36/1929
and the entry of these family members into the
Garbhagudi is indispensable and imperative to continue the
said practices and that the impugned Official Memorandum
issued by respondent No.1-Deputy Commissioner has
come in the way of continuing with the said practice.
Therefore, seeks for quashing of the said Official
Memorandum.

16. Learned HCGP justifying the impugned Official
Memorandum submits that respondent No.3-Chief
Executive Officer, who has been appointed to the
Institution in terms of Section 24A is vested with powers
and duties prescribed under the Rules to ensure the same
are adhered to. He refers to Rule 33B of Karnataka Hindu
Religious Institutions and Charitable Endowments Rules,

that respondent No.3-Chief Executive Officer is responsible
to ensure the obligation casted under the said Rules are
maintained which also includes performance of daily
poojas and some sevas in the temple are continued.
17. He submits it is in furtherance to this power vested,
respondent No.3-Chief Executive Officer found violation of
the rituals prompting him to submit the report dated
24.11.2024 as per Annexure-B to the Writ petition

24. As rightly pointed out by Sri Harish Narasappa, learned
Senior Counsel for Sri Shivaraj Balloli appearing for the
petitioners neither of these documents refers to the
provisions of law which is invoked by these two officers
justifying issuance of such communications.
25. Needless to state that, before issuing such memorandum
and the communication it was incumbent on the part of
respondent No.3-Executive Officer as well as Respondent
No.1-Deputy Commissioner to have conducted an enquiry
to ascertain as to what was the practice prevalent in the
temple which petitioner is alleged violating of. Omnibus
general statement of violation cannot give credence to an
order of this nature which has resulted in prohibiting the
hereditary trustee from discharging his duties which are
recognized and protected under sub-section (1) of Section
25A of the Act 1997.

26. No doubt Executive Officer, who is an appointee under
Section 24A of the Act 1997, is required to ensure
performance and compliance of acts and deeds as
encapsulated under Rule 33B of Rule 2002. Nothing is
emanating from the impugned report dated 24.11.2024
and memorandum dated 22.12.2024 respectively
regarding any such action being taken in furtherance to
the provisions contained under Rule 33-B.
27. This being the factual and legal aspect of the matter in the
order dated 06.02.2025 which is subject matter of the writ
petition in W.P.No.102900/2025, respondent No.2-Deputy
Commissioner in purported exercise of his power under
Section 25B (6) and (ii) of the Act 1997 even while
appointing respondent No.5 therein as (Belli Betha

Carrier) has proceeded to direct the Executive Officer to
conduct enquiry in furtherance to his report dated
24.11.2024 (as extracted above) and to submit a report
within the time mentioned therein. There is no reference to
any provision of law for respondent No.2-Deputy
Commissioner to issue such a direction either.

28. Though impugned Official Memorandum dated 22.12.2024
prohibits hereditary trustee to allow anyone other than him
and the nominated Archaka from entering the Garbhagudi,
it does not mention as to the basis on which such
restriction and prohibition is imposed.
29. Petitioners in W.P.No.106994/2025 have elaborately set
out the practices which according to them are required to
be performed and have been performed since time
immemorial which invariably requires them to enter the
Garbhagudi of the temple. Nothing is forthcoming from the
impugned report and the official memorandum issued by
the respondent No.1-Deputy Commissioner and
respondent No.3-Executive Officer whether or not such
practices have been performed in the temple.
30. Necessary to note that notified institution with an annual
income exceeding Rs.5 lakhs up to Rs.25 lakhs come under
the administrative supervision of Deputy Commissioner.
Power in this regard is traceable to Section 25B of the Act
1997.

institution is admittedly over Rs.4.00 to 5.00 Crores, it is
Rajyadharmika Parishat vested with the power to deal with

34. Clearly neither the respondent No.1-Deputy Commissioner
nor respondent No.3-Executive Officer are vested with the
power to issue Official Memorandum and the

case. Since the impugned Official Memorandum alleged
violation of the religious practices, customs and usages
