CORAM: HON'BLE MR. JUSTICE RAJESH RAI K
ORAL ORDER
This petition is filed under Section 482 of Cr.P.C. to quash
the FIR against the petitioners/accused Nos.1 to 9 in Crime
No.33/2024 dated 06.03.2024 registered by Mysuru City
Women Police Station for the offences punishable under
Sections 498A, 504 r/w 149 of IPC and Sections 3 and 4 of
Dowry Prohibition Act, on the file of VII Additional Civil Judge
(Jr.Dn.) and JMFC, Mysuru.
2. During the course of arguments, learned counsel for the
petitioners submits that the dispute between the petitioners
and respondent No.2 is matrimonial in nature and that the
parties have amicably settled their dispute outside the Court
with the intervention of elders and family members. In this
regard, learned counsel has placed on record a copy of the
petition filed seeking divorce by mutual consent under Section
13(B) of the Hindu Marriage Act, 1955. A perusal of the said
petition indicates that petitioner No.1 has agreed to pay a sum
of Rs.26,00,000/- to respondent No.2 towards full and final

settlement, towards maintenance of their daughter. Out of the
said amount, a sum of Rs.6,00,000/- has already been paid by
petitioner No.1 to respondent No.2, and the parties have
agreed that the remaining balance amount of Rs.20,00,000/-
shall be paid at the time of recording of evidence in the
proceedings under Section 13(B) of the Hindu Marriage Act,
1955 .
3. It is further submitted that respondent No.2 has also
agreed to give her consent for quashing the criminal
proceedings initiated against the petitioners pursuant to the
complaint lodged by her, which came to be registered in Crime
No.33/2024.
4. In view of the petition filed under Section 13(B) of the
Hindu Marriage Act, 1955, seeking divorce by mutual consent,
and the submissions made by learned counsel for the
petitioners, it is evident that the parties have amicably settled
their matrimonial dispute. Since the dispute is purely private
and matrimonial in nature, continuation of the criminal
proceedings would serve no useful purpose. Accordingly, the

The petition is accordingly disposed of in terms of the
above observations.
However, liberty is reserved to respondent No.2 to seek
