1. The applicant has filed the present Original Application under Section
19 of the Administrative Tribunals Act, 1985 seeking the following
reliefs: -
a) Quash and set aside the impugned departmental actions or
orders that have disturbed the applicant’s promotional avenue
and seniority.
b) Direct the respondent to restore the applicant’s original
promotional line (Mali-Rukh-Overseer).
c) Direct consideration of the applicant’s promotion to Rukh-
Overseer with all consequential benefits.
d) Pass such other order(s) as this Hon’ble Tribunal may deem
just and proper.
2. The applicant, who is presently working as Assistant Stockman in the
Sheep Husbandry Department, UT of Ladakh, has approached this
Tribunal essentially seeking restoration of his earlier promotional
avenue from the post of Mali to Rukh-Overseer. It is his case that

under the recruitment rules prevailing prior to the reorganisation of
the erstwhile State of Jammu and Kashmir, the post of Mali carried a
promotional avenue to the post of Rukh-Overseer. According to the
applicant, the subsequent Recruitment Rules, 2022 altered the
promotional hierarchy by introducing the post of Assistant Stockman
as an intermediate post, thereby adversely affecting his seniority and
promotional prospects.
3. Learned counsel for the applicant submits that the grievance of the
applicant may, at this stage, be considered by the competent authority
in accordance with the applicable rules and the relevant provisions of
the Jammu and Kashmir Reorganisation Act, 2019, including the
protection, if any, available to the applicant in respect of his service
conditions.
4. Having regard to the nature of the grievance raised and without
expressing any opinion on the merits of the claim, we deem it
appropriate to dispose of the present Original Application by
permitting the competent authority to examine the matter in the first
instance.

5. Accordingly, the present Original Application itself shall be treated as
a representation on behalf of the applicant. The competent authority
amongst the respondents is directed to consider the grievance raised
by the applicant in the OA, particularly with regard to his claim
concerning the promotional avenue/cadre position and the protection
of his service rights under the applicable rules and law, and thereafter
pass a reasoned and speaking order, strictly in accordance with law,
within a period of six weeks from the date of receipt of a certified
copy of this order. The decision so taken shall be communicated to the
applicant forthwith.
6. It is made clear that this Tribunal has not expressed any opinion on
the merits of the claim of the applicant, and all issues are left open for
consideration by the competent authority.
7. With the aforesaid directions, the Original Application stands
disposed of. No order as to costs.
