Order on Board
03.11.2026
1. These are the first bail applications filed under Section 483 of the
Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail
to the applicants who have been arrested in connection with
Crime No. 216/2026 registered at Police Station Nawagarh,
District Bemetara (C.G.), for the offence punishable under
Sections 4, 6 and 10 of Chhattisgarh Agricultural Cattle Preservation
Act, 2004 r/w Section 11(1)(D) of Prevention of Cruelty to Animals
Act, 1960 and Section 3(5) of Bhartiya Nyaya Sanhita, 2023.
2. The case of the prosecution, in brief, is that Police Station
Nawagarh received secret information regarding the illegal
transportation of cattle in a vehicle. Acting upon that information,
the police intercepted a pick-up truck bearing registration No. CG
25 L 7556 and found five buffalo calves loaded in a congested
manner. The vehicle was being driven by applicant Jaypal Sahu,
with applicant Rajendra Yadav seated as the conductor/cleaner.

3
Accordingly, the aforesaid case was registered against them, and
during the course of the investigation, they disclosed the name of
applicant Dharnidhar @ Vinod Yadav as the purchaser of the said
cattle.
3. Learned counsel appearing for the respective applicants jointly
submit that the applicants have been falsely implicated in the
present case, as the cattle were being transported solely for
agricultural purposes, and there is nothing on record to
demonstrate that they were intended for slaughter. It is further
submitted that applicant Dharnidhar @ Vinod Yadav had
purchased the said cattle from applicant Rajendra Yadav for valid
consideration, and owing to familial relations between them,
applicants Jaypal Sahu and Rajendra Yadav were traveling
together in the vehicle. They contend that applicants Dharnidhar
@ Vinod Yadav and Rajendra Yadav have no criminal
antecedents, while applicant Jaypal Sahu has two prior cases
which are not of a similar nature. It is also submitted that the
charge-sheet has already been filed, the applicants have been in
custody since 23.09.2026 and 24.09.2026 respectively, and the
conclusion of the trial is likely to take considerable time. On these
grounds, they pray for grant of regular bail to the applicants.
4. On the other hand, learned counsel for the State opposes the bail
applications and submits that the applicants were actively
involved in the illegal transportation of cattle for the purpose of

4
slaughter. He further submits that one of the applicants has two
pending criminal antecedents; therefore, the applicants are not
entitled to be enlarged on bail.
5. I have heard learned counsel appearing for the parties and
perused the case diary.
6. Taking into consideration the facts and circumstances of the case,
the nature and gravity of the allegations levelled against the
applicants, and the fact that applicants Dharnidhar @ Vinod
Yadav and Rajendra Yadav have no criminal antecedents while
applicant Jaypal Sahu has two antecedents which are not of a
similar nature; further considering that the charge-sheet has
already been filed before the competent court, the applicants
have been in judicial custody since 23.09.2026 and 24.09.2026
respectively, and conclusion of the trial is likely to take time, this
Court is of the view that the applicants are entitled to be released
on bail.
7. It is directed that in the event of the applicants executing a
personal bond for a sum of Rs. 50,000/- to the satisfaction of the
concerned trial Court, they shall be released on bail on the
following conditions:-
(a) they shall make themselves available for
interrogation by the police officer as and when
required;
(b) they shall not directly or indirectly make any

5
inducement, threat or promise to any person
acquainted with the facts of the case so as to
dissuade him from disclosing such fact to the
Court; and
(c) they shall not act in any manner which will be
prejudicial to a fair and expeditious trial.
The observation made hereinabove is for the purpose of
deciding these bail applications only, the learned trial Court shall
decide the case on its own merits.
