3. During the hearing on 16.10.2026, based on the statement
made before this Court, that the said document was still retained by
the 4th respondent, the document was directed to be produced.
Today, the said document was placed before this Court to ascertain
the allegations made by the petitioner.
4. It was the case of the 9th respondent that, even before the
registration of the document, a dispute had arisen between the 9th
respondent and the petitioner, which led to a police complaint. Upon
recording the petitioner's statement that he had already executed the
registered sale deed, the complaint was closed. Thereafter, following
the registration of the documents, the petitioner lodged another
complaint, which was enquired into by the 7th respondent, who also
concluded that there was no fraud or illegality in the registration of
the documents. The submissions made by the learned counsel for the
9th respondent were also supported by the learned Government
Advocate (Criminal Side), on the strength of the counter affidavit filed
by the 7th respondent.
5. On perusal of the original documents placed before this
Court, this Court was prima facie convinced of the allegations. This
Court, in exercise of its jurisdiction under Article 226 of the
Constitution of India, cannot delve into the disputes raised by the

parties. It would be appropriate for the petitioner to approach the
competent Civil Court for appropriate relief in respect of the registered
document. Hence, this Court is not inclined to further examine the
disputed allegations made in respect of the document sought to be
declared illegal, null and void, and non est in the eye of law.
6. In that regard, when this Court made its view clear, the
learned counsel appearing for the petitioner sought disposal of the
Writ Petition with liberty to the petitioner to approach the competent
Court. However, the learned counsel prayed that this Court restrain
th
the 4 respondent from releasing the document for a limited period
after completion of the procedural formalities. According to the
learned counsel, if the document is released, it would only lead to
further litigation.
7. The learned counsel appearing for the 9th respondent would
submit that the 9th respondent would neither deal with nor encumber
the property in any manner during the said limited period and,
therefore, there is no necessity to restrain the release of the
document. Though the learned counsel for the 9th respondent has
undertaken that the property would not be encumbered, this Court is
of the view that no prejudice would be caused to the 9th respondent if
the document is retained by the 4th respondent for a limited period,
within which the petitioner may initiate appropriate civil proceedings

before the competent Civil Court and seek interim protection.
8. In such view of the matter, the Writ Petition stands disposed
th
of with a direction to the 4 respondent to retain the document for a
period of three months from today. It is for the petitioner to work out
his rights, as claimed in this Writ Petition, before the competent Civil
Court. If the petitioner fails to institute a suit within the aforesaid
th
period, the 4 respondent is at liberty to release the document to the
th
9 respondent, subject to fulfilment of the other requirements.
There shall be no order as to costs. Consequently, the connected
miscellaneous petitions are closed.
