unauthorized construction put up by the 6th respondent premises, which
is running in the name and style of "Paragon Polymer Products Private
Limited Unit 2", which is situated in bearing S.No.125/3A, Karumapuram
Village, Attur Main Road, Salem District.

Writ of Mandamus has been instituted to direct R5 to comply
the order dated 04.12.2024 made in Na.Ka.No.2622/2024/SoMo-1,
which was passed by the 3rd respondent herein and to take action for
demolition of the huge unauthorized construction put up by the 6th
respondent premises, which is running in the name and style of
"Paragon Polymer Products Private Limited Unit 2", which is situated in
bearing S.No.125/3A, Karumapuram Village, Attur Main Road, Salem
District.
2. The grievance of petitioner is that 6th respondent has
unauthorizedly constructed building posing danger to employees as well
as all neighbouring buildings.

3. Learned counsel for petitioner relied on the counter
affidavit filed by R3 and submitted that there are violations and
unauthorized constructions noticed.
4. In this context, learned Additional Government Pleader
appearing for R1 to R5 would submit that R3 / Deputy Director of Town
and Country Planning has filed a counter affidavit on 18.08.2025, stating
that the representation of the petitioner was forwarded with a direction to
th
the 5 respondent to inspect and find out as to whether there is any
deviation. In this regard, Block Development Officer conducted
inspection and given written instructions to learned Additional
Government Pleader vide letter dated 07.10.2026. In the said instruction,
BDO has stated that petitioner has set out four allegations against R6. In
respect of the said allegations, the same were false and buildings got
approvals by competent authorities.
5. Needless to state that if at all any such approval already
granted is running counter to the principles of law or violation of Statute
or Rules in force, petitioner is at liberty to challenge the building approval
granted by competent authorities. However, as of now, relief as such
sought for in the writ petition deserves no further examination.
