JUDGMENT
(Judgment of the Court was delivered by C.V.KARTHIKEYAN, J.)
st nd
The writ appeal has been filed by the 1 and 2 respondents in the
writ petition questioning the interim order of the learned Single Judge
dated 28.04.2026 in WMP(MD) No.9764 of 2026 filed in WP(MD) No.
2/5

W.A.(MD)No.644 of 2026
13009 of 2026, by which interim order, the learned Single Judge had
permitted the respondents to write their respective examination in law
course in Mukil College of Law, Athencode in Kanyakumari District.
Questioning that particular permission granted, the writ appeal had been
filed and a Coordinate Division Bench, by an order dated 06.05.2026,
had granted stay of the said order. Aggrieved by that stay, the
respondents/students took up the issue further before the Hon'ble
Supreme Court. The Hon'ble Supreme Court had however not disturbed
the order of stay but rather had granted liberty to adjudicate the issue in
the writ appeal.
2. The learned Senior Counsel appearing on behalf of the
respondents stated that the period of examination has already been over
and owing to the order of stay granted, the respondents were not able to
write their examination and that therefore, that particular issue had
become redundant.
3. The learned Additional Advocate General appearing on behalf of
the appellants also stated that the University had taken up the permission
granted to write the examination as a legal issue.

4. We would keep all the points of law open to be agitated before
the learned Single Judge, where the writ petitions are still pending
including the issues relating to the right of the College to admit the
students, whether proper sanction of the Bar Council is required and
whether counselling has to be undergone before admitting the students in
the College and any other issue, which could be taken up during the
course of hearing.
5. Recording that the period of examination is over and it may not
be proper for us to take up the issue as that would deprive both the
appellants as well as the respondents in the writ petition their right of
intra Court of appeal, we would dispose the writ appeal without
expressing any views on the grievance of either the appellant or the
respondents. All points raised by the parties may be agitated before the
learned Single Judge. No costs. Consequently connected Miscellaneous
Petition is closed.
