CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR
ORAL JUDGMENT
Date : 01-09-2026
Heard Mr. Shrish Anurag, learned Advocate for the
petitioner and Mr. Rajeev Kumar Sinha, learned Advocate for
the State.
2. The petitioner, an Institute of Pharmacy
represented through its Secretary, has approached this Court
seeking a direction upon the concerned respondents to take a
final decision on the report submitted by the Expert Committee
constituted by the order contained in Memo No. 1006(17) dated

Patna High Court CWJC No.13216 of 2026 dt.01-09-2026

04.10.2023 issued by the Officer on Special Duty, Health
Department, Government of Bihar, pursuant to which the
Committee inspected the petitioner’s College on 02.12.2023 and
submitted its report before the Health Department.
3. Adverting to the facts, learned Advocate for the
petitioner contended that the petitioner’s institution had
submitted an application before the Health Department,
Government of Bihar for grant of ‘No Objection Certificate’ for
running D. Pharm and B. Pharm courses with intake capacity of
60 and 100 respectively for the academic session 2023-24. On
04.10.2023, the Officer on Special Duty, Health Department,
Government of Bihar issued an order constituting an Expert
Committee for inspection of the College; accordingly, the
College in question was inspected by the Expert Committee and
the report thereof, which, according to the petitioner, is in
favour of the institution, was submitted to the Health
Department, Government of Bihar, Patna. However, despite the
fact that the report of the Expert Committee was submitted long
back on 02.12.2023, ‘No Objection Certificate’ has not been
issued in favour of the petitioner’s institution till date. On
account of inaction or laches on the part of the concerned
respondent authorities, the petitioner’s institution has been

deprived from admitting the students for the academic sessions
2023-24 till 2026-27.
4. Learned Advocate for the State on the other hand
seeks a short adjournment to apprise this Court with regard to
the present position/status of the claim of the petitioner.
5. Having considered the nature of the grievance and
the materials available on record which clearly demonstrates
that the Expert Committee has already inspected the Institute in
question long back on 02.12.2023 and the report has already
been submitted to the Health Department, Government of Bihar,
but till date no final order has been passed with regard to
issuance of ‘No Objection Certificate’, this Court finds it apt
and proper to dispose off the writ petition with a direction to the
Additional Chief Secretary, Health Department, Government of
Bihar, Patna to take up the representation of the petitioner, copy
of which is marked as Annexure-P/3 and bring to its logical
conclusion, preferably within a period of four weeks from the
date of receipt/production of a copy of this order.
6. It is made clear that the matter has been pending
for about two years and till date no decision has been taken and,
as such, any violation to the timeframe shall be viewed
seriously.

7. This disposes the writ petition.
