C.R.P.Nos.3718, 3733 and 4344 of 2025
2. The Petitioners herein are related to one another. The Petitioner in
C.R.P.No.4344 of 2025 (N.Radhakrishnan) and the Petitioner in C.R.P.No.3733
of 2025 (R.Sujatha) are husband and wife. The Petitioner in C.R.P.No.4344 of
2025 (N.Radhakrishnan) is uncle of the Petitioner in C.R.P.No.3718 of 2015.
nd
3. The Petitioners availed loans from the 2 Respondent Society
amounting to Rs.5,00,000/-, Rs.3,30,000/- and Rs.5,00,000/- respectively in the
year 2013.
4. Against the aforesaid loans, the respective Petitioners only partly
discharged their liability and defaulted in repaying the remaining dues.
5. As per the sanctioned terms and conditions, the loans were to be repaid
nd
to the 2 Respondent Society within six months from the date of sanction, along
with interest at the rate of 14.5% per annum. Since the loans were not repaid
within the stipulated time, surcharge notices were issued on various dates,
st
culminating in Arbitration Awards passed by the 1 Respondent under Section
90 of the Tamil Nadu Co-operative Societies Act, 1983, in Arbitration Case
Nos.1/2018-2019, 2/2018-2019 and 3/2018-2019, all dated 25.03.2019.

C.R.P.Nos.3718, 3733 and 4344 of 2025
6. Aggrieved by the said Arbitration Awards, the respective Petitioners
approached the Co-operative Tribunal (Principal District Court, Vellore) by
filing appeals under Section 152(1)(a) of the Tamil Nadu Co-operative Societies
st
Act, 1983. The Co-operative Tribunal affirmed the orders passed by the 1
Respondent.
7. The Impugned Judgment and Decree of the Co-operative Tribunal is
st
defended by both the learned Government Advocate for the 1 Respondent as
nd
well as the learned counsel for the 2 Respondent. They submit that the
Impugned Judgment and Decree does not suffer from any illegality or
procedural infirmity warranting interference under Article 227 of the
Constitution of India.
8. Having considered the submissions made by the learned counsel for the
st
Petitioners, learned Government Advocate for the 1 Respondent, and the
nd
learned counsel for the 2 Respondent and upon perusal of the Impugned
Judgment and Decree challenged in the respective Civil Revision Petitions, this
Court is of the considered view that the Petitioners have failed to make out a
case for interference.

nd
9. Admittedly, the Petitioners borrowed funds from the 2 Respondent
Society but failed to liquidate the outstanding liability within the stipulated time
st
after having made only partial payments. Consequently, the 1 Respondent
passed the Arbitral Awards dated 25.03.2019, which were sustained by the
Co-operative Tribunal.
10. The reasons assigned in the Impugned Judgment and Decree do not
disclose any material irregularity or procedural infirmity in the decision making
process warranting interference by this Court in the exercise of its supervisory
jurisdiction under Article 227 of the Constitution of India.
11. In view of the foregoing findings, I find no merits in these Civil
Revision Petitions. Therefore, they are liable to be dismissed.
12. Accordingly, these Civil Revision Petitions are dismissed. No costs.
Connected Civil Miscellaneous Petitions are closed.
