ORAL ORDER

Learned counsel for the petitioner and the learned
counsel for the respondents are present.

2. Learned counsel for the respondents files
memo producing three documents.

3. Heard the learned counsel for the petitioner
and also the learned counsel for the respondents on the
petition. Perused the relevant materials on record.

4. This petition is filed by the petitioner under
Section 528 of BNSS praying to quash the order dated
23.07.2026 of the learned II Addl. District and Sessions
Judge, Yadgir, sitting at Shorapur (for short ‘the
revision Court’) in Crl.R.P. No.5005/2026, wherein the
revision petition filed by the petitioner is allowed in part
and the amount of Rs.20,00,000/- ordered by the
learned Principal Civil Judge and JMFC, Shorapur (for
short ‘the learned Magistrate’) as per the order dated

CRL.P No. 201250 of 2026

02.05.2026 in Crl.Misc. No.116/2026 is modified
reducing to Rs.12,00,000/- and also the interim
monthly maintenance of Rs.5,000/- granted by the
learned Magistrate to the respondent No.1 and 3 is
cancelled and the interim monthly maintenance of
Rs.5,000/- each to the respondent No.2, 4 and 5 is
reduced from Rs.5,000/- per month to Rs.4,000/- per
month.

5. Being aggrieved by the said order, the
petitioner is before this Court in the present petition.
The petition in Crl.Misc. No.116/2026 is filed by the
respondents against the petitioner under Section 144(1)
of BNSS for interim maintenance and also for marriage
expenses of the respondent No.2, who is the daughter of
the petitioner and the respondent No.1.

6. It is not in dispute that the respondent No.1
is wife, the respondent No.2, 4 and 5 are daughters and

the respondent No.3 is son of the petitioner. The
learned Magistrate as per the order dated 02.05.2026
has directed the petitioner (respondent therein) to pay
interim maintenance of Rs.5,000/- each to the
respondents (petitioners therein) and also directed to
pay marriage expenses of Rs.20,00,000/- regarding
marriage of the respondent No.2.

7. It is undisputed fact that the order passed by
the learned Magistrate is only regarding interim
maintenance of the all respondents and the amount
Rs.20,00,000/- for marriage expenses of the respondent
No.2 fixed to be performed. The matrimonial dispute
between the petitioner and the respondent No.1 shall
not cause any inconvenience to their children for their
livelihood and maintenance.

8. It is pertinent to note that an amount of
Rs.20,00,000/- ordered by the learned Magistrate is

reduced to Rs.12,00,000/- by the revision Court.
Moreover, in the petition on hand, the petitioner has
undertaken to pay Rs.6,00,000/- towards marriage
expenses of the respondent No.2 and hence, interim
stay was granted. But, the petitioner has failed to
comply with the same and he has also failed to pay
Rs.6,00,000/- to the respondents towards marriage
expenses of the respondent No.2.

9. Now the learned counsel for the respondents
has produced letter issued by the Karnataka Neeravari
Nigam Ltd., which would show that the petitioner is
recognized Class-1 Contractor in Public Works
Department. Therefore, the contention of the petitioner
that he is not able to pay expenses of the marriage to
the respondent No.2 prima facie does not merit
consideration and accordingly, no ground is made out
by the petitioner to set aside the impugned order.

and consequently, the same is liable to be dismissed.

10. In the result, I proceed to pass the following:

ORDER

i. The petition is hereby dismissed.

ii. Consequently, the order dated
23.07.2026 of the revision Court in
Crl.R.P. No.5005/2026 is hereby
confirmed and the petitioner is
directed to pay amount of
Rs.12,00,000/- in compliance of the
said order, earlier to the date of
marriage of the respondent No.2
without fail.
iii. The learned Magistrate is directed to
expedite the matter pending before
the trial Court and dispose of the
same at the earliest.
