th
joining 64 batch of Diploma Course in Sports Coaching (2026-27) at
NSNIS, Patiala has been rejected despite his selection for the course, as
intimated vide letter dated 22.07.2026.
4. Case of the Petitioner is that he was enrolled in Indian Air Force on
28.03.2007 as an Aircraftsman under sports quota for wrestling. Petitioner
represented Air Force in several inter-service tournaments and won many
medals in his category between 2008 to 2024. On 07.04.2026, Air Force
th
Sports Control Board disseminated information for 64 batch of Diploma
Certificate in Sports Coaching (2026-2027) detailing the necessary QRs.
Petitioner appeared in the written examination on 31.05.2026, after
qualifying all QRs and taking necessary permission from CO, CPRU to
appear in the examination and qualified the same. Thereafter, Petitioner
appeared for physical test and interview and was informed vide letter dated
22.07.2026 that he was selected for the course and he accordingly paid the
course fee and hostel fee on the same day. However, on 25.09.2026,
Petitioner was informed in response to an online query that he could not be
spared for the course since the same was completing in June-July, 2027,
whereas Petitioner was proceeding on discharge in March, 2027, before the
completion of the one year course. This compelled the Petitioner to file the
present petition.
5. Learned counsel for the Petitioner submits that after a long career in
wrestling and having got several medals for the Air Force, he cleared the
th
written as also physical test and interview for 64 batch of Diploma Course
in Sports Coaching (2026-27), however, Petitioner has been denied
permission to join the course arbitrarily. The only reason forthcoming in
response to the online query by the Petitioner is that he will proceed for

discharge before completion of the one year diploma course. This, according
to the learned counsel, can be no reason to deny permission for joining the
course, after Respondents granted him permission to appear in the selection
process, which he has successfully cleared. Though not pleaded, during the
course of hearing learned counsel has given a list of few names, which
according to him are of personnel who were permitted to attend the course in
the past few years, despite the fact that they were retiring either on the date
of completion of the courses or soon thereafter and it is urged that no
discrimination can be made with the Petitioner as this will violate Article 14
of the Constitution of India.
6. Counsel for the Respondents, on the other hand, submits that the
th
decision to deny permission to join the 64 batch of Diploma Course in
Sports Coaching (2026-27) was not arbitrary and has its basis in a policy
letter dated 09.12.2020, which deals with “ADMISSION IN NSNIS
DIPLOMA COURSE IN SPORTS COACHING”. The objective of the
policy is to have maximum number of trained and qualified coaches in the
units/stations for promotion of sports at grassroot level so that these
qualified coaches, after NIS training, further provide necessary training at
various Air Force units/stations and there is increased representation of
sportsmen at unit/station level. This being the objective of the policy, if
Petitioner is permitted to join the course, which ends only after Petitioner is
discharged in March, 2027, he will not be able to impart training to the
others and the entire purpose and objective of the policy will be defeated. As
for the argument that some personnel were sent for the courses, which were
ending on or closer to the dates of their discharge, it is argued that there may
be some aberrations but now strict measures have been put in place to ensure

that the policy is not violated.
7. Having heard learned counsels for the parties, we are of the view that
there is no merit in the submissions made by the counsel for the Petitioner.
Admission to NSNIS Diploma Course in Sports Coaching is regulated by
policy letter dated 09.12.2020, copy of which is handed over during the
course of hearing and taken on record. Reading of the policy makes it clear
that the objective behind the policy is to have maximum number of trained
and qualified coaches so that these qualified coaches after NIS training are
able to provide necessary training to others in the Air Force units/stations
and consequently, there is maximum representation of sportsmen. This
objective cannot be achieved if the diploma course ends after the person sent
for the course is discharged from service or even where the course concludes
in closer proximity to the date of discharge. In the instant case, Petitioner
th
will be discharged from service in March, 2027, whereas the 64 batch of
Diploma Course in Sports Coaching (2026-27) ends in June-July, 2027 i.e.,
after the discharge of the Petitioner and therefore, Petitioner will be unable
to further train the sportsmen and the objective of the policy will be
defeated. It is pertinent to note that there is no challenge to the policy before
us and on the reading of the same, the objective of the policy has a
reasonable nexus with the object sought to be achieved. We do not find any
arbitrariness in the impugned decision of the Respondents.
8. Insofar as the argument of discrimination is concerned, we may note
that this issue is not pleaded in the writ petition and was orally put forth by
counsel for the Petitioner. Be that as it may, we take on record the stand of
the Respondents, candidly put forward that in the past there were some
aberrations, however, measures have been put in place to ensure that policy

is not violated in future. In any event, if others have been permitted to attend
courses in violation of the policy, we cannot perpetuate the wrong and it is
trite that there is no negative equality in law and consequently, there is no
question of violation of Article 14 of the Constitution of India.
9. At this stage, learned counsel for the Petitioner submits that direction
be issued to the Respondents to refund the course fee as also the hostel fee.
We find this to be a reasonable prayer and it is accordingly directed that
Respondents shall refund the course fee as also the hostel fee to the
Petitioner within four weeks from today.
10. Writ petition is accordingly dismissed along with pending application.
