Order on Board
28/10/2026
1. By the present petition, the petitioner has prayed for following
reliefs:-
“10.1 That this Hon'ble Court may kindly be pleased
to call for the entire records pertaining to the case of
the petitioner.
10.2 That, this Hon'ble Court may kindly be pleased
to quash/set-aside the impugned attachment order
dated 13.10.2026 (Annexure P/1), issued by
respondent no. 6 i.e. Executive Engineer, Rural
Engineering Service, Division Mohla, District Mohla
Manpur Ambagarh Chowki, C.G., in the interest of
the justice.
10.3 That, this Hon'ble Court may kindly be pleased
to direct the respondent authorities to permit the
petitioner to continue discharging his duties at his
substantive place of posting i.e. Sub Divisional
Office, Rural Engineering Services, Sub-Division
Ambagarh Chowki,, District Mohla Manpur
Ambagarh Chowki, C.G., with all consequential
benefits, in the interest of the justice.
10.4 That, any other relief which the Hon'ble Court
may deemed fit and proper also be granted to the
petitioner, in the interest of justice.”
2.
Learned counsel for the petitioner submits that the impugned
order dated 13.10.2026 assigns the charge of the post of Sub-
Divisional Officer (S.D.O.), Rural Engineering Services, Sub-
Division Manpur, District Mohla-Manpur-Ambagarh Chowki, to
the petitioner on the ground that one Sagar Kumar Shende,
Assistant Engineer, RES, Division Mohla, has been relieved
from Mohla. Learned counsel contends that the reason

3
assigned in the impugned order is self-contradictory, inasmuch
as, while the order records that the said Sagar Kumar Shende
has been relieved from Mohla, it simultaneously assigns the
charge of Sub-Division Manpur to the petitioner on the basis of
the said relieving. Learned counsel further submits that the
petitioner has already been relieved from his earlier place of
posting, i.e., Ambagarh Chowki, and the said relieving order is
under challenge in a separate writ petition bearing WPS No.
7388/2026. Hence, the assignment of the charge of Sub-
Division Manpur to the petitioner, vide the impugned order, is
bad in law.
3. Learned counsel for the respondents, on instructions, places
reliance on the order dated 22.04.2026 and submits that Sagar
Kumar Shende, Assistant Engineer, was holding the charge of
Sub-Division Manpur in addition to his duties at Division Mohla.
Learned counsel further submits that, upon the relieving of
Sagar Kumar Shende from the charge of both Division Mohla
and Sub-Division Manpur, the charge of Sub-Division Manpur
was assigned to the petitioner owing to administrative
exigencies. Accordingly, learned counsel contends that no
illegality or infirmity can be attributed to the impugned order
(Annexure P-1).
4. I have heard learned counsel for the parties, perused the
pleadings and documents.

4
5. Having considered the submissions advanced by learned
counsel for the parties and upon perusal of the material
available on record, it appears that Sagar Kumar Shende,
Assistant Engineer, Rural Engineering Services, Division
Mohla, was also holding the charge of Sub-Division Manpur.
Upon his being relieved from the charge of Division Mohla as
well as Sub-Division Manpur, the charge of Sub-Division
Manpur was assigned to the petitioner owing to administrative
exigency. Therefore, no illegality is found in the impugned
order warranting interference by this Court.
6. Accordingly, the writ petition is dismissed .
