punishable under Sections 69, 351(2), 351(3) of the BNS,
2023 against the petitioner herein based on the typed first
information dated 07.07.2026 submitted by respondent
No.2, who is alleged victim in the present case. During
the course of investigation of the said case, petitioner was
arrested on 14.07.2026 and remanded to judicial custody.
His bail application filed before the jurisdictional Sessions

5. Per contra, learned High Court Government
Pleader and learned counsel for the respondent No.2, who
has filed statement of objections, have opposed the bail
application.

6. Learned counsel for the respondent No.2
submits that petitioner had suppressed his marital status
and made a false promise of marrying the victim girl and
had sexual intercourse with her. Subsequently, petitioner
has refused to marry her and thereafter the victim girl
came to know that petitioner is already married. He
submits that petitioner has recorded certain private photos
and videos of the victim girl which he had circulated in
social media. Accordingly, he prays to dismiss the petition.

7. A reading of the typed first information dated
06.07.2026, which was submitted on 07.07.2026, before

show that the petitioner and the victim girl were working
in the same company, subsequently, they developed
friendship and petitioner allegedly promised to marry the
victim girl and had sexual intercourse with her. In the first
information it is stated that after about two year from their
acquaintance, petitioner had borrowed money using the
credit card of the victim girl and therefore, there was a
quarrel between them and at that stage, the victim girl
came to know that the petitioner was married and he is
having a 7 year old child. The victim girl had therefore,
confronted the petitioner and asked him to delete her
private photos and videos which he had in his mobile
phone. She had also approached Chandra Layout Police
Station on 06.06.2024 and the police had summoned the
petitioner to the police station and the petitioner allegedly
had admitted his guilt and had deleted all private photos
and videos of the victim girl. It is specifically stated in the
first information that a NCR case was registered in this
regard by Chandra Layout Police Station, which was

subsequently closed. In the first information, it is further
alleged that thereafter the petitioner has been threatening
of forwarding private photos and videos of the victim girl
in social media and he also allegedly had refused to repay
the money, which he was due to pay her. It is further
alleged that the petitioner has criminally intimidated the
victim girl and also her family members. It is under these
circumstances, the victim girl approached the police on
07.07.2026.

8. From the aforesaid, it is apparent that on
06.06.2024 when the victim girl had approached the
Chandra Layout Police Station, she was very much aware
that the petitioner was married and in the first information
it is stated that the petitioner had deleted all the private
photos and videos of the victim girl in the said police
station. Therefore, the allegation now made against the
petitioner that he has been threatening to circulate the

private photos and videos of the victim girl becomes
difficult to be believed.

9. A reading of the first information as well as the
charge sheet which is filed before the Court, would go to
show that the victim girl and the petitioner had consensual
sexual relationship. In the event, the petitioner had
suppressed his marital status and had made a false
promise to the victim girl and thereafter had sexual
intercourse with her, the victim girl ought to have filed a
complaint with such allegations while she had earlier
approached Chandra Layout Police Station on 06.06.2024.
The very fact that on the basis of her complaint, NCR case
was registered and subsequently, the same was closed,
would go to show that such allegations were not made by
the victim girl against the petitioner in the earlier
complaint which was filed on 06.06.2024 before the
Chandra Layout Police Station.

10. Petitioner, who is a married man, is in custody
in the present case from 13.08.2026. Investigation of the
case is already completed. Though learned counsel for the
respondent No.2 has made an allegation that the
petitioner has forwarded the private photos and videos of
the victim girl in social media, the fact remains that police
have not invoked the offence punishable under the
provisions of Information Technology Act in the present
case against the petitioner. The maximum punishment for
the offences alleged in the present case is imprisonment of
10 years. Considering the aforesaid aspects of the matter,
and more so, the nature of allegations found in the first
information as well as the charge sheet, the following:
