other’s property. Though in the present petition, the petitioner who is real
sister having neuropathic disability can also be considered as well wisher and
natural guardian in absence of any material contrary to show that sister will
not take proper care of the interest of the property of the person who is
having neuropathic disability, I found no reason to exercise my jurisdiction
under Article 226 of Constitution of India looking to the peculiar facts and
circumstances of the case.
5] Counsel for the respondent/State has submitted that appropriate
orders may be passed.
6] Heard. Having considered the rival submissions and on perusal of
the disability certificate Annexure P-5, it is apparent that petitioner's sister is
suffering from intellectual disability and as per the disability certificate
issued by Civil Surgeon she is 90% disabled.
7] In such facts and circumstances, the mental and physical state of the
petitioner’s sister that she is suffering from Intellectual disability and as per
disability certificate showing 90% disability and apparently the same must
have caused incomprehensible difficulties to the petitioner who is
continuously taking care of her sister. In such facts and circumstances, and
also taking note of the decisions rendered by various high Courts in the cases
o f Philomena Leo Lobo(supra), R.Usha (supra), Rajni Hariom Sharma
(supra),Sairabanu Mohammad Rafi(supra), Sayardevi Chaudhary(supra),

(supra), this Court is of the considered opinion that it is a fit case where the
