[2] Captioned main WA is an intra-court appeal assailing ‘an
order dated 25.09.2026 made in MC [W.P. (C)] No. 749 of 2026 in W.P.
(C) No. 722 of 2026 by a Hon’ble Single Judge’ (‘impugned order’ for the
sake of convenience and clarity). R1 in the captioned WA (Nishita Laishram
Laishram, daughter of Laishram Noren Singh) took the NEET examination
qua Academic Year 2026-27 for MBBS seat and she secured 325 marks
out of 720, her State rank is 1,009 (One Thousand and Nine) and National
Rank is 5,00,285 (Five Lakh and Two Hundred Eighty Five).
[3] After first and second round of counselling, R1 did not get
admission in any of the four medical colleges in the State of Manipur.
Thereafter, R1 submitted a representation dated 18.08.2026 seeking
Page 2 of 6
modification of particulars entered qua registration in the Manipur Medical
e-Counselling 2026-27. Case of R1 in the representation is that she
registered through a cybercafe (R2), a mistake had occurred there as seat
type option was shown as ‘Government’ . In and vide her 18.08.2026
representation, R1 inter alia made a request to change it as ‘Management’
seat type. This representation was rejected by way of a speaking order
dated 21.08.2026 bearing Reference No. MED-506/16/2023-HS-HEALTH-
rd
Part(2) made by 3 appellant . Inter alia assailing this speaking order, R1
filed a WP in W.P. (C) No. 722 of 2026. To be noted, the WP is still pending
before the Hon’ble Single Bench. Pending WP, in and vide MC [W.P. (C)]
No. 749 of 2026, R1 made a prayer to allow her to participate in third
round of counselling qua ‘Management’ seat and she sought stay of
rd
operation of the 21.08.2026 speaking order made by 3 appellant. In this
MC, in and vide impugned order, Hon’ble Single Judge made an order of
interim direction saying that R1 should be allowed to participate in the
then ongoing third round of counselling qua ‘Management’ quota by
converting her choice of seat from ‘Government’ to ‘Management’ .
Assailing this order, State has filed the captioned main WA.
[4] Learned AG for State Manipur and Senior Advocate, Mr.
Lenin Hijam instructed by Ms. Thanyomi Keishing, learned State counsel
inter alia submitted that seat type once chosen cannot be changed.
[5] Issue notice.
[6] Mr. S. Johnson, learned counsel who is present in Court,
accepts notice for R1 and Mr. Kh. Tarunkumar, learned senior advocate
appears on his behalf. Mr. S. Gunabanta, learned counsel who is present
in Court accepts for R3 and Mr. HS Paonam, learned senior advocate
appears on his behalf. As regards R2, which is the cybercafe, we dispense
with notice in the captioned WA and MC thereat owing to the order we
propose to make in the light of the trajectory the matter has taken and
submission of learned senior counsel for R1.
[7] This Court, with the consent of all the afore-referred counsel
and senior counsel took up and heard out the main WA, R1 and R3 waiving
the formality of filing affidavits-in-opposition in the captioned MC.
[8] This Court is informed by all learned counsel and senior
counsel that third round of counselling has since been completed and R1
was allowed to participate. Learned Advocate General submitted that one
Soibam Ranjanba Singh whose NEET score is 285 marks out of 720 has
been admitted in ‘Management’ seat type in ‘Shija Academy of Health
Sciences’ (‘SAHS’ for the sake of brevity) by making it clear/on condition
that his admission is subject to the outcome of captioned WA i.e., W.A.
No. 29 of 2026. Learned Advocate General, elaborating on this, submitted
that this means that if R1 succeeds in the legal drill, Soibam Ranjanba
Singh should make way/leave the college i.e., SHAS and R1 will be
admitted in his place.
[9] In the aforesaid scenario, Mr. Kh. Tarunkumar, learned
senior counsel submitted that another round of counselling which is known
is stray counselling has also taken place and he would like to seek
Page 4 of 6
moulding of relief/modification of prayer in the WP. According to learned
senior counsel, candidates with lesser score than R1 have got admission
in the stray counselling. We express no opinion on this submission.
Nonetheless, as learned counsel for R1 has now opted to go
before the Hon’ble Single Bench and seek appropriate relief inter alia by
way of modification of prayer or moulding of relief, we make it clear that
admission of afore-referred Soibam Ranjanba Singh in SHAS qua
Management seat type is now subject to outcome of W.P. (C) No. 722 of
2026. To be noted, scanned reproduction of the admission proceedings
dated 26.10.2026 placed before this Court is as follows.
In the aforesaid proceedings, as regards Sl. No. 3,
‘ WA/29/2026 - State of Manipur & 2 Others Vs. Nishita Laishram & 2
others’ shall now read as ‘W.P. (C) No. 722 of 2026 – Nishita
Laishram Vs. The State of Manipur & 4 Ors’ .
[10] Though obvious, we make it clear that when R1 approaches
Hon’ble Single Bench, the question of effecting service on R2(cybercafe)
will be considered by Honble Single Bench and Honble Single Bench shall
consider the matter on its own merits and in accordance with law
untrammeled by observations made in the impugned interim order. To put
in differently, observations in the impugned interim order will neither
impede nor impel/catalyze submissions of either side and for this purpose,
all questions are left open for being canvassed in the pending WP viz.,
W.P. (C) No. 722 of 2026 and/or any other MCs (if taken out therein).
[11] Captioned main WA is disposed of as closed albeit with
observations as above and preservation of rights and contentions as setout
supra. Consequently, captioned MC thereat has become otiose and the
same is also disposed of as closed. There shall be no order as costs.
