Prayer in WP(MD). 26763/ 2023 :Writ Petition is filed under Article 226 of
the Constitution of India, praying this Court to issue a Writ of Mandamus,
directing the respondents 1 to 4 to complete the road work in public
pathway situated in Survey No.63/3, Arasathoor Village and Panchayat,
Kattimangalam Group, Thiruvadanai Taluk, Ramanathapuram District by
considering the petitioner representation dated 10.10.2023 within a time
frame that may be stipulated by this Court.

The writ petition had been filed in the nature of Public Interest
Litigation seeking a mandamus against the respondents 1 to 4 to complete
the road work in a public pathway in S.No.63/3 in Arasathoor Village and
Panchayat, Kattimangalam Group, Thiruvadanai Taluk, Ramanathapuram
District.
2. In the affidavit filed in support of the writ petition, it had been
contended that the petitioner and the village people had sought a road to be

laid in S.No.63/3. It had been stated that the work to lay the road was
th
prevented by the 5 respondent, who was occupying S.No.63/4. He had
also filed a suit in OS No.71 of 2023 before the District Munsif Court at
Thiruvadanai. However, the same was dismissed for default on 14.11.2024.
3. The learned Additional Government Pleader clarifies that the road
is being laid only in the land in S.No.63/3 and not in S.No.63/4. This
th
clarification is issued again by us. Therefore the 5 respondent need not
obstruct the laying of the road. The respondents 1 to 4 may proceed with the
laying of the road in S.No.63/3 as sought by the writ petitioner in the writ
petition. The said road may be laid within a period of two months from the
date of receipt of a copy of this order.
The writ petition stands disposed of. No costs.
