Order on Board

1. By the present petition, the petitioner has prayed for following
reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to
direct the respondent authorities particularly from the
office of respondent No.2 & 6 to provide all the
documents in relation to the "Mid Day Meal Scheme" for
the period of 04-04-2013 to March-2021 including all the
bills vouchers, cash book, bank transaction details, bank
scrolls and "Mid Day Meal Scheme" payment certificate
issued by the respondent No.6 to Incharge Clerk of the
said scheme.
10.2 That, this Hon'ble Court may kindly be pleased to
direct the respondent authorities to stay the further
proceeding relating to the notice dated 19-12-2025
(Annexure P-4) issued by the respondent No.2 to the
petitioner, till the complete documents, which sought by
the petitioner is provided to him.
10.3 That, the Hon'ble Court may kindly be pleased to
grant any other relief, as it may deem-fit and
appropriate.”
2. Learned counsel for the petitioner submits that the petitioner is
seeking the documents referred to in Relief Clause 10.1 on the
ground that a charge-sheet was issued to the petitioner along
with the communication dated 19.12.2025 at Page No. 41.
However, the charge-sheet, which is stated to have been
supplied to the petitioner as part of the said documents, has
3
never been supplied to him. He submits that though the
petitioner has repeatedly requested the concerned authority to
supply a copy of the charge-sheet, but the same has not been
supplied to him. Learned counsel further submits that the
present writ petition has been filed seeking supply of the
relevant documents, including bills and vouchers, cash books,
bank transaction details, bank scrolls, “Mid Day Meal Scheme”
payment certificates, etc.
3. Learned counsel for the respondents, on instructions, submits
that the charge-sheet has been issued to the petitioner and
has already been supplied to him. However, he submits that if
the petitioner approaches respondent No. 2 afresh by filing an
appropriate application, a copy of the charge-sheet shall be
supplied to him. Learned counsel further submits that, at this
stage, the present writ petition is not maintainable, as the
petitioner has failed to indicate as to how the documents
sought by him are relevant or necessary at the present stage
of the proceedings.
4. I have heard learned counsel for the parties, perused the
pleadings and documents.
5. Considering the submissions advanced by learned counsel for
the parties and upon perusal of the record, it appears that the
petitioner has not annexed a copy of the charge-sheet. The
petitioner has also failed to demonstrate as to how the
4
documents sought by him are relevant and necessary for
submitting his reply to the charge-sheet issued against him.
Accordingly, at this stage, no such direction can be issued to
the respondents. However, it is directed that, in the event the
petitioner approaches respondent no. 2 for supply of a copy of
the charge-sheet, the same be supplied to him within a period
of ten days from the date of receipt of such application.
6. With the aforesaid direction, the present writ petition is
disposed of. SD/-
