7. Learned counsel for the respondents has filed the counter affidavit, in
which it has been stated that the eligibility list dated 04.09.2013 was
prepared for selection to the post of Senior Clerk in Grade Pay of Rs. 2,800
under the 66⅔% promotion quota. Due to inadvertence, the name of Shri
V.P. Singh, a medically de-categorized employee senior to the applicant, was
omitted and subsequently included at Serial No. 1 vide office letter dated
06.09.2013. Against 24 vacancies (UR-09, SC-08 and ST-07), eligible staff
were called for the written suitability test as per the extant rules. Since the
applicant, Laxmi Narayan, was placed at Serial No. 9 in the original eligibility
list and the inclusion of Shri V.P. Singh affected the number of candidates to
be called against the nine unreserved vacancies, the applicant's name was
deleted from the list, and he was informed accordingly vide office letters
dated 06.09.2013 and 17.10.2013. The respondents further state that
medically de-categorized employees belonging to other cadres were
adjusted in accordance with the applicable rules. It is also submitted that the
applicant had already been granted the second and third financial
RAJEEV KUMAR MISHRA

OA No. 627 of 2015

upgradations under MACPS in Grade Pay of Rs. 2,000 and Rs. 2,400,
respectively, before his retirement on 30.06.2014. The representation dated
22.03.2014 of the applicant was not received in the office, whereas the
applicant had already been informed in detail about the deletion of his name
from the eligibility list. Therefore, there is no illegality or infirmity in the order
passed by the respondents.

8. In rejoinder affidavit, the applicant has reiterated the similar facts as
given in the OA.

9. Before passing the impugned order, the applicant was aged about 60
years and has already retied much prior to filing of the OA. It is not in dispute
that the applicant superannuated from service on attaining the age of
superannuation. Once the applicant has superannuated, the issue of
promotion cannot be reopened. Since the applicant is no longer in service,
no relief can be granted for retrospective promotion. Recently, the Apex
Court while dealing with the matter regarding retrospective effect promotion
and seniority in case of Government of West Bengal & Ors. Versus Dr. Amal
Satpathi & Ors., reported in 2024 SCC Online SC 3512, it has been held as
under:-
…. “19. It is a well settled principle that promotion becomes effective from the
date it is granted, rather than from the date a vacancy arises or the post is
created. While the Courts have recognized the right to be considered for
promotion as not only a statutory right but also a fundamental right, there is
no fundamental right to the promotion itself. In this regard, we may gainfully
refer to a recent decision of this Court in the case of Bihar State Electricity 10
Board and Others v. Dharamdeo Das , wherein it was observed as follows:
“18. It is no longer res integra that a promotion is effective from the date it is
granted and not from the date when a vacancy occurs on the subject post or
when the post itself is created. No doubt, a right to be considered for
promotion has been treated by courts not just as a statutory right but as a
fundamental right, at the same time, there is no fundamental right to
promotion itself.
Furthermore,
RAJEEV KUMAR MISHRA

OA No. 627 of 2015

“20. In State of Bihar v. Akhouri Sachindra Nath15, it was held that
retrospective seniority cannot be given to an employee from a date when he
was not even borne in the cadre, nor can seniority be given with retrospective
effect as that might adversely affect others. The same view was reiterated in
Keshav Chandra Joshi v. Union of India.
20. In the instant case, it is evident that while respondent No. 1 was
recommended for promotion before his retirement, he could not assume the
duties of the Chief Scientific Officer. Rule 54(1)(a) of the West Bengal Service
Rules, clearly stipulates that an employee must assume the responsibilities of
a higher post to draw the corresponding pay, thus, preventing posthumous or
retrospective promotions in the absence of an enabling provision.”
21. While we recognize respondent No.1’s right to be considered for
promotion, which is a fundamental right under Articles 14 and 16(1) of the
Constitution of India, he does not hold an absolute right to the promotion
itself. The legal precedents discussed above establish that promotion only
becomes effective upon the assumption of duties on the promotional post and
not on the date of occurrence of the vacancy or the date of recommendation.
Considering that respondent No. 1 superannuated before his promotion was
effectuated, he is not entitled to retrospective financial benefits associated to
the promotional post of Chief Scientific Officer, as he did not serve in that
capacity.”

10. In view of the above discussions, no relief is permissible to the
applicant in respect of his promotion after his retirement. Therefore, the
instant Original Application is liable to be dismissed and is accordingly,
dismissed being devoid of merit.

11. All associated MAs also stand disposed of.
