4. Learned counsel for the applicant, in addition to the grounds

pleaded in the application, submits that the applicant has been falsely
implicated in this matter merely on the basis of a transaction made by
Rajendra Parihar into the bank account of M/s Mac Auto India Private
Limited. M/s Mac Auto India Private Limited was dealing with Rajendra
Parihar regarding supply of vehicles. Various payments were made by
Rajendra Parihar on behalf of Janpad Panchayat, Chicholi. The applicant was
not aware and had no reasons to doubt that the transaction in question relates
to embezzlement of funds by Rajendra Parihar. Learned counsel further
referring to the order dated 09.02.2026 passed in SLP (Crl.) No.20756/2025
submits that the main accused Rajendra Parihar has been extended benefit of
anticipatory bail by the Supreme Court. The other co-accused persons
namely, Shivalu, Anjali Keshri, Sonu @ Kaushalchand, Sumit Soni, Arjun
Shivnakar, Surkesh Kahar and Jamdu Singh have also been extended benefit
of anticipatory bail in the matter. The prosecution against the applicant is
identical. The applicant is proprietor of M/s Mac Auto India Private Limited
and is aged around 44 years. The applicant is ready to cooperate in the
investigation. He has family responsibilities and business to look after. There
is no likelihood from fleeing from justice. The prosecution is based on
documentary evidence and money trail which has already been seized. There
is no likelihood of tempering with evidence already seized. On these
grounds, it is prayed that applicant be released on anticipatory bail.
5. Per contra, learned counsel for the respondent/State opposes the
prayer for grant of anticipatory bail and submits that money was transferred

in the account of the applicant, therefore, he is involved in the crime. The

investigation is underway relating to verification of accounts. Considering
the gravity of alleged offence, the applicant may not be extended benefit of
anticipatory bail. However, after going through the case diary, learned
counsel for the State submits that no criminal antecedent is reported against
the applicant.
6. As per the accusation on case diary, Indira Mehto, Senior Account
Officer of Jila Panchayat, Betul submitted a written complaint to the SHO of
Police Station Chicholi, District Betul inter-alia alleging that the Janpad
Panchayat Bhempur and Janpad Panchayat Chicholi were allotted funds
under the 'Swachha Bharat Mission Scheme'. Rajendra Parihar, Block
Coordinator of the 'Gramin Swachha Bharat Mission Scheme' and other
officers embezzled fund and made unauthorized illegal payments to various
vendors and private individuals. On verification of amount, it was revealed
that an amount of Rs.12,69,000/- was transferred into account of M/s Mac
Auto India Private Limited. Accordingly, FIR was registered against
proprietor of M/s Mac Auto India Private Limited at Crime No.163/2025 at
Police Station, Chicholi. The investigation is underway. All co-accused
persons including the main accused Rajendra Parihar, have been extended
benefit of anticipatory bail. Applicant is apprehending his arrest in the
matter. The prosecution is based on verification of accounts. The material
documentary evidence is already seized. The veracity of the prosecution will
be considered on merit after evidence.
7 . As informed, the applicant is aged around 44 years and has

responsibility of dependent family. Considering the age and status of the

applicant, there appears to be no likelihood of fleeing from justice or
involving in any criminal activity. Considering the socio-economic status of
the applicant, there appears to be no likelihood of tampering with the
evidence, influencing the witness or interfering in the investigation by the
applicant. The incarceration of applicant does not appear to be necessary for
the purpose of investigation. The grant of anticipatory bail to the applicant
will not cause prejudice to free, fair and full investigation. Considering his
age and family and social status, the applicant may suffer hardship and
prejudice due to incarceration entailing social disrepute and humiliation.
Considering the overall circumstances of the case, but without commenting
on merits of the accusation, this Court is inclined to grant anticipatory bail to
the applicant. Thus, the application is allowed.
8. Accordingly, it is directed that in the event of arrest of applicant -
Mohd. Naeem Akhtar shall be released on bail in connection with Crime
number as mentioned in the first paragraph of this order, upon furnishing a
