In W.P.No.27097/2026, the petitioner has sought for a
writ in the nature of certiorari to quash the order dated
25.03.2024 passed by the respondent No.1 in case
No. J.Dgï.©./©.¹.E/PÉ.f.J¥sï/524/2021-22 , in respect of land in
Sy.No.4/3 measuring 629 square meters of Doddakari Village,
Bethamangala Hobli, Bangarpet Taluk, Kolar District. He has
also sought for restoration of proceedings and decide the same
as provided under Section 3G(5) of the National Highways Act,
1956 (henceforth referred to as 'the Act, 1956').

for a writ in the nature of certiorari to quash the order dated
25.03.2024 passed by the respondent No.1 in case

Sy.No.85(85/1) measuring 3655 square meters of Rayasandra
Village, Kyasamballi Hobli, Bangarpet Taluk, Kolar District. He
has also sought for restoration of proceedings and decide the
same as provided under Section 3G(5) of the Act, 1956.
7. (i) The petitioner in W.P.No.27097/2026 is the
owner of land in Sy.No.4/3 measuring 629 square meters of
Doddakari Village, Bethamangala Hobli, Bangarpet Taluk, Kolar
District. The petitioner in W.P.No.26558/2026 is the owner of
land in Sy.No.5 (new No.7) measuring 2716 square meters of
Kulur Village, Bethamangala Hobli, KGF Taluk, Kolar District.

The petitioner in W.P.No.26711/2026 is the owner of land in
Sy.No.4 (4/3) measuring 2753 square meters of Doddakari
Village, Bethamangala Hobli, Bangarpet Taluk, Kolar District.
The petitioner in W.P.No.26716/2016 is the owner of land in
Sy.No.4/3 measuring 354 square meters of Doddakari Village,
Bethamangala Hobli, Bangarpet Taluk. The petitioner in
W.P.No.26741/2026 is the owner of land in Sy.No.4(4/3)
measuring 2597 square meters of Doddakari Village,
Bethamangala Hobli and the petitioner in W.P.No.26888/2026
is the owner of the land in Sy.No.85(85/1) measuring 3655
square meters of Rayasandra Village, Kyasamballi Hobli,
Bangarpet Taluk, Kolar District.
(ii) The Union of India had acquired portions of the
aforesaid survey numbers for the purpose of Bangalore-
Chennai Expressway and thereafter, the respondent No.2 had
passed an award determining the compensation payable.
Notice of the award was issued to the petitioners. The
petitioners thereafter approached the respondent No.1 under
Section 3G(5) of the Act, 1956. The said proceedings were
dismissed by the respondent No.1 on the ground that it was

beyond the period of limitation prescribed. The petitioners
being aggrieved by the said order are before this Court.
8. The learned counsel for the petitioners submitted
that the notice of the award was issued to the petitioners in the
year 2017 and 2018 respectively and that under Article 137 of
the Limitation Act, 1963(henceforth referred to as 'the Act,
1963'), the petitioners were entitled to invoke Section 3G(5) of
the Act, 1956 within three years from the date of receipt of the
award notice. She contends that the country was gripped by
COVID-19 and the Hon'ble Supreme Court in the case of Suo
Motu W.P.(C) No.3/2020 had excluded the period from
15.03.2020 to 28.02.2022 for the purposes of determining
limitation. She therefore contends that the petition filed by the
petitioners before the respondent No.1 was well within
limitation and the respondent No.1 did not consider the
judgment of the Hon'ble Apex Court referred supra . She
therefore prays that the impugned orders passed by the
respondent No.1 be set aside and the proceedings before the
respondent No.1 be restored and a direction be issued to the
respondent No.1 to consider the same in accordance with law.

9. The learned Additional Government Advocate for
respondent No.1 as well as the learned counsel for the
respondent Nos.2 and 3 in unison submitted that though the
petitioners are entitled for exclusion of the period between
15.03.2020 to 28.02.2022 in view of the judgment of the
Hon'ble Apex Court in the case of Suo Motu W.P.(C)
No.3/2020 , yet, the petitioners have approached this Court
belatedly and hence, no indulgence can be shown to the
petitioners. They therefore contend that the petitions are liable
to be rejected. They further contend that if this Court were to
set aside the order passed by the respondent No.1 and direct
the respondent No.1 to reconsider the case of the petitioners,
then the petitioners be denied the interest for the delayed
period.
10. I have considered the submissions of learned
counsel for the petitioner and the learned Additional
Government Advocate for the respondent No.1 and the learned
counsel for the respondent Nos.2 and 3.
11. The notice of the award was served on the
petitioners in these petitions somewhere in the year 2017 and

2018 respectively. The petitioners had initiated proceedings
under Section 3G(5) of the Act, 1956, during the year 2021-
2022, which was rejected by the respondent No.1 on the
ground that the same was beyond the limitation prescribed
under Article 137 of the Act, 1963. However, the respondent
No.1 was oblivious of the fact that the country was gripped by
COVID-19 pandemic and the Hon'ble Supreme Court in the
case of Suo Motu W.P.(C)No.3/2020 had specifically
excluded the period from 15.03.2020 to 28.02.2022 for the
purposes of calculating limitation. If the benefit of the judgment
of the Hon'ble Apex Court in Suo Motu referred supra is
granted to the petitioners, then the proceedings before the
respondent No.1 was well within limitation. Consequently, the
impugned order passed by the respondent No.1 is liable to be
set aside.
12. As regards the contention of the learned counsel for
the respondent Nos.2 and 3 that the petitioners have belatedly
approached this Court, it is relevant to note that the petitioners
in W.P.Nos.27097/2026, 26558/2026, 26711/2026,
26716/2026, 26741/2026 and 26888/2026 have approached

this Court after more than two years from the date of the order
passed by the respondent No.1. Therefore, as rightly contended
by the learned Additional Government Advocate for the
respondent No.1 and the learned counsel for the respondent
Nos.2 and 3, the petitioners cannot benefit from the delay in
approaching this Court. Therefore, the petitioners in
W.P.Nos.27097/2026, 26558/2026, 26711/2026, 26716/2026
and 26741/2026 are not entitled to interest from the period
25.03.2024 and the petitioner in W.P.No.26888/2026 is not
entitled to interest from the period 08.12.2023, till the date of
filing these writ petitions namely 19.08.2026. The respondent

iii. All the proceedings before the respondent No.1
mentioned above, are restored and the
respondent No.1 shall consider the same in
accordance with law without reference to the point
of limitation;
iv. The respondent No.1 shall ensure that the
petitioners are not granted the interest for the
period specified above if the petitions filed by the
petitioners are considered favourably;
