d. A writ of Mandamus, commanding the Respondents 1 to 4
to forward the case of the petitioners to Respondent No. 5
for onwards accord of sanction to their posts for
consideration of regularization of the petitioners and also
for releasing of the withheld wages.
e. A writ of Mandamus, commanding the Respondents to
process the case of the petitioners for their regularization
as per policy decisions read with the judgments rendered
by Hon'ble Apex Court as well as by this Hon'ble court and
relcase the withheld wages of the petitioners from the
month of July, 2014 till date and they be paid in future
regularly and also produce the whole record pertaining to
the process initiated by them for onwards consideration of
the petitioners cases for regularization and also the
measures taken by them while passing the impugned
notice for perusal and consideration of this Hon'ble court
for passing the appropriate orders therein.
f. Any other writ, order or direction may also be passed in
favor of the Petitioners and against the Respondents as
the Hon'ble court deems fit in the interest of justice.

3. It is stated in T.A./2289/2021 that the petitioners came to
be engaged as casual labourers in the respondent department
from the years 2007 to 2014, and as stated, the petitioners are
continuing in the respondent department on the date of institution
of the instant Writ Petition. The petitioners seek their continuation
against the post of casual labourers held by them notwithstanding
the notice published by the respondents in the Daily Greater
Kashmir dated 11.01.2016, by virtue of which tenders have been
invited for hiring of Security Guards from Private Security Agencies,
at the cost of the petitioners herein, and the petitioners have also
sought consideration for seeking their regularization in tune with
the policy, decisions and the judgments rendered by the Hon'ble

4. The matter came up for consideration on 22.01.2016 before
the Hon'ble High Court of J&K at Srinagar, wherein the order
passed is reproduced hereunder:

5. Thereafter, various orders on file reveals that the petition
was admitted to hearing on 18.08.2017 and the respondents were
directed to file the counter affidavit. Thereafter, the matter
remained before the Hon'ble High Court of J&K and was finally
transferred to the Jammu Bench of the Hon'ble CAT vide order
dated 07.07.2020, and for some time, the matter has remained
unattended before this Tribunal as well.
6. The respondents have filed their affidavit which is signed by
the Director, Tourism, J&K Government, Kashmir, same is on file
which bears the date of 04.09.2019.
7. Perusal of the reply affidavit reveals that in terms of an

order bearing No. 109-DTK of 2019 dated 22.02.2019, the Director,
Tourism Kashmir, constituted a committee of five officers to
scrutinize the particulars of casual labourers, and the committee
was apprised of the fact that no record of individual cases is
available in the Directorate of Tourism, as these have been washed
away in the devastating floods of 2014. As such, the committee

could not find any record of proper engagement orders of the said
casual labourers, however, it is stated that only one file under the
name of “Est./147/DTK” was made available before the Committee
consisting of some communications relevant to the subject matter.
On the basis of the records produced before the committee, the
committee after scrutinizing the same along with the deliberations
held with the officials of the respondents department and
representatives of the casual labourers, the committee arrived at
the following observations, which are reproduced hereunder:
a. As reported by Dy. Director M&W, the services ol the
casual labourers on the basis of watch & ward of the
departmental assets were being utilized from time to
time & 144 such casual labourers had drawn wages

c. In February 2014, Directorate of Tourism Kashmir
forwarded a list of 482 casual labourers to the
Administrative department vide No.: Orch /219/DTK,
dated: 30.06.2014 which implies that services of 338
more casual labourers were utilized on need basis
during the period 2013-2014.
8. It is further stated in the reply that in the year 2017, the
Finance Department issued instructions to all the departments for
Aadhar Based Biometric Identification & Skill Profiling of the casual
labourers, and a list of 342 candidates was forwarded, who were
working up to issuance of disbanding orders and were uploaded on
Government Portal by Directorate of Tourism, Kashmir. It is also

9. Mr. M. M. Dar, learned counsel for the petitioners, while
submitting his arguments submitted that as regards the ‘relief (a)’
claimed by him, in the instant petition, the same having been
rendered as infructuous, he would not like to press the same.
However, as regards, other reliefs, he submits that the case of the
petitioners can be considered by the respondents on their own
merits and in accordance with law. To which, he submits that he
has already made a prayer that he seeks consideration only strictly
in accordance with procedure, the law and the judgments passed
by the Hon’ble Supreme Court of India from time to time and other
High Courts of the Country.

10. In rebuttal, Mr. Syed Musaib, learned DAG, submits that due
to shortage of staff, short time engagements of the petitioners on
any project of the respondents department were made, but
however, the petitioners were duly reimbursed and were paid, and
the respondents have acted strictly in accordance with the
Government Policy and applicable rules, and there has been no

arbitrariness, illegality or any violation of any fundamental rights.
He further submits that in the light of the law laid down by the
Hon’ble Apex Court in the case titled as State of Rajasthan & Ors.
v. Dayalal & Ors. 2011 (2) SCC 429 wherein their lordships have
reiterated that daily rated wagers or temporary employees have
no right to claim regularization, unless their initial appointment
was made in accordance with the recruitment rules and through
proper selection and their long continuation in service does not
create a legal right to their regularization coupled with the fact
when the petitioners herein have only continued up to 2013 at the
sites for manning them only on need basis.
