PRAYER: Writ Petition filed under Article 226 of the Constitution of India
for issuance of Writ of Certiorarified Mandamus, calling for the records

pertaining to the impugned order passed by the 3 respondent in his
proceedings Moo.Mu.Aa2/2680/2023 dated 20-06-2024 and quash the
same, and direct the respondents 1 to 3 to remove all encroachments in
S.No.112/2 thereby restoring the water body/vaari, enabling the free flow
of water.

ORDER

The order dated 20.06.2024 passed by the Revenue Tahsildar,
Thittakudi stating that S.No.11/2 is a patta land standing in the name of
the respondents 4 to 9 is under challenge in the present writ petition.

2.The petitioner would submit that S.No.112/2 is a water
channel/vaari and the respondents 4 to 9 have encroached upon the
water body. Therefore, the present writ petition is filed.
3.The learned Additional Government Pleader based on the written
instructions given by the Tahsildar, Thittakudi dated 29.10.2026 would
submit that during the course of inspection, the authorities found that the
land in S.No.112/1 is classified as Government poramboke/vaari and as
far as the land covered in S.No.112/2 is concerned, it is a Patta land. To
substantiate the said contention, the Tahsildar has produced the xerox
copy of the “A” Register which would show that the land in S.No.112/1 is
classified as Government poramboke/vaari and S.No.112/2 has been
stated as Patta land and the Patta stood in the name of one Rajavel.
4.In view of the fact that the authorities have not identified any
encroachment in S.No.112/2, no further consideration needs to be
undertaken.

5.Accordingly, the Writ Petition stands dismissed. No costs.
Consequently, connected miscellaneous petitions are closed.
