ORAL ORDER

Writ Petition Nos.202627/2025, 202353/2025,
202579/2025, 202707/2025, 202709/2025, 202855/2025
are filed by the owners/land losers for the relief of
mandamus directing the respondents - Land Acquisition
Officer to release the compensation amount as per the
award passed under Section 28-A of the Land Acquisition
Act.

2. Writ Petition Nos. 201555/2025, 202321/2025,
202513/2025, 203305/2025, 203373/2025, 203377/2025
and 203524/2025 are filed by the beneficiary of the
acquisition, challenging the award passed by the Land
Acquisition Officer under Section 28-A of the Land
Acquisition Act, solely on the ground that the Land
Acquisition Officer has relied on the judgment and award
passed in LAC No.1 of 2021 and the said award is for the
land which is stated as non-agricultural (N.A.) land.

3. Sri A.M. Nagaral, learned counsel appearing for
the petitioner – beneficiary of acquisition submits that the
respondents’ lands were acquired for the purpose of
formation of a ring road around the Kalaburagi city. It is
submitted that the Land Acquisition Officer passed an
award determining the market value at Rs.10,76,652/- per
acre for non-agricultural lands. The land owner of land in
Sy.No.76/2 sought a reference and the Reference Court
re-determined the market value at Rs.170/- per sq.ft. in
LAC No.1/2021. Based on such award, now the Land
Acquisition Officer awarded compensation to the
respondents at Rs.170/- per sq.ft. by ignoring the fact that
the lands of the respondents are agricultural lands and
Rs.170/- per sq.ft. is awarded to non-agricultural land. It
is further submitted that the Land Acquisition officer has
not heard the petitioner – beneficiary while passing the
award as the beneficiary is required to pay the
compensation. Hence, the impugned award is liable to be
set aside. In support of his contention, he placed reliance

on the judgment of the Co-ordinate Bench of this Court in
the case of The Chief Administrative Officer,
Karnataka Neeravari Nigam Limited vs. The Special

4. Learned counsel Sri Sanjeev Kumar C. Patil
appearing for the petitioner – land owners submits that
the lands covered in these petitions are acquired under the
preliminary notification dated 03.03.2005 and acquisition
for the purpose of formation of ring road and the petitioner
in connected matters are the beneficiaries of the
acquisition and Land Acquisition Officer determined the
market value at Rs.170/- per square feet placing reliance
on the LAC No.1 of 2021 and the said LAC is again based
on the earlier judgment in LAC No.470 of 2012 wherein
the market value is determined at Rs.170/- per square
feet. It is submitted that the judgment in LAC No.1 of
2021 and LAC No.470 of 2012 have attained finality and

the claimants have filed appeals challenging the said

5. It is submitted that despite award being in
favour of the petitioners – land owners, the compensation
is not paid. Hence, he seeks to issue a writ in the nature of
mandamus to the respondent – Land Acquisition Officer to
release the compensation amount as per the award passed
in favour of the petitioners – land owners. He seeks to
allow the petitions of the land owners by dismissing the
petitions of the beneficiary.

counsel for the petitioner – beneficiary, petitioner – land
owners, learned Additional Government Advocate for the
State Government and Land Acquisition Officer. Perused
the material available on record. I have given my anxious
consideration to the submissions advanced.

compensation amount as per the award passed under
Section 28-A of the L.A. Act, respectively.

8. The respondent – State Government issued
preliminary notification under Section 4 (1) of the L.A. Act
on 03.03.2005 with an intention to acquire various extent
of lands in different villages for the purpose of formation of
ring road around Kalaburagi city. The final notification
under Section 6(1) of the L.A. Act was published on
25.07.2005. The acquisition by the respondent – State is
to the extent of 42 acres 32 guntas of various villages
which are covered under the aforesaid notifications. The
Land Acquisition Officer determined the market value at
Rs.10,76,652/- per acre vide award dated 08.07.2008 in
respect of one of the land owners and a similar award
came to be passed in respect of the other land owners as

well. One Sri Shivanand Mankar owner of land in
Sy.No.76/2 of Brahmapura village sought a reference
under Section 18(1) of the L.A.Act. The Reference Court
in LAC No.1/2021 re-determined the market value at
Rs.170/- per sq.ft. vide judgment and award dated
01.12.2023 as per Annexure-B in Writ Petition No.
202321/2025. The respondents herein filed an application
before the Land Acquisition Officer under Section 28-A of
the L.A. Act seeking prayer to pass an award by re-
determining the compensation as per LAC No.1/2021. The
petitioner – beneficiary filed objection to the application
filed by the land owner by contending that the land in
question are not the converted lands for non-agricultural
purpose and they are agricultural lands, hence benefit of
the judgment and award in LAC No.1/2021 cannot be
granted to the land owners. The Land Acquisition Officer,
vide order dated 20.03.2025 allowed the application filed
by the petitioner – land owners by awarding compensation
at Rs.170/- per sq.ft.

9. The Land Acquisition Officer had relied on the
judgment rendered in LAC No.1/2021 passed by the
Reference Court and re-determined the compensation as
provided under Section 28-A of the L.A. Act. The
Reference Court in LAC No.1/2021 had considered the oral
and documentary evidence adduced by the parties and
recorded detailed findings with regard to the nature of
land, potentiality, and by referring to the various
documentary evidence at para-12 and 13 of the judgment
comes to a conclusion that the compensation awarded in
LAC No.470/2012 by the Reference Court which is also
acquired under the same notification, determined the
market value at Rs.170/- per sq.ft. It is to be noticed that
the subject land and the lands covered in LAC No.1/2021
and LAC No.470/2012 are acquired for formation of ring
road in the Kalaburagi city and lands are adjacent to the
Municipal limits and have non-agricultural potential. The
aforesaid judgments of the Reference Court do not make
any distinction with regard to the market value of the

agricultural land and non-agricultural land. Admittedly, the
lands in question have non-agricultural potential and the
impugned order passed by the Land Acquisition Officer is
based on the judgment in LAC No.1/2021 and the said
judgment of the Reference Court is again based on the
judgment in LAC No.470/2012. The perusal of the
aforesaid two judgments makes it clear that the nature of
land in the subject writ petition and the nature of land in
the aforesaid judgment are one and the same. The
Reference Court in LAC No.470/2012 at para-18 observed
that the award passed by the Land Acquisition Officer it is
revealed that the land belong to claimant was found to be
an agricultural land and further it is observed that the
acquired land is situated near the State Highway and
surrounding land has been developed and respondent No.2
in their objections had admitted that acquired land is
within the limits of Corporation and GDA and further
observed that the Land Acquisition Officer considering the
acquired land as a dry land appears to be not proper and

without considering its non-agricultural potentiality. The
Reference Court in the said judgment at para-19 to 21
considered the evidence on record more particularly the
sale transactions and referring to the judgments passed in
other reference proceedings allowed the claim petition in
part and determined the market value at Rs.170/- per
sq.ft. with statutory benefits.

10. It is to be further noticed that the beneficiary of
the acquisition had challenged the award passed by the
respondent – Land Acquisition Officer under Section 28-A
of the L.A. Act dated 18.12.2021 before this court in W.P
200652/2023 in KARNATAKA ROAD DEVELOPMENT

ANNARAO POLICE PATIL AND ORS. This Court vide
order dated 05.06.2024 dismissed the writ petition. The
relevant paragraphs of the aforesaid judgments are

higher compensation in respect of acquisition of a
similarly situated land, enhanced the compensation
determined by the Land Acquisition Officer. Therefore,
respondent No.1 was also entitled to be similarly treated
by respondent No.2. Therefore, no objections can be
raised by the petitioner in the respondent No.1 making a
claim for similar compensation paid to the land loser in
LAC No.470/2012 by invoking Section 28(A) of the L.A.
Act. As a matter of fact, having regard to the purport and
purpose of Section 28(A) of the L.A. Act, it was incumbent
upon respondent No.2 to have informed all the land losers
in Hirapur village about the compensation enhanced by
the Reference Court and he must have taken steps to re-
determine the compensation for all the land losers in that
village. Since that was not done, respondent No.1 was
justified in making a request to respondent No.2 to
redetermine the compensation. Therefore, the petitioner
cannot challenge the award passed by respondent No.2,
re-determining the compensation.
7. A perusal of the award shows that the petitioner had
also participated in the proceedings and after hearing the
petitioner, the compensation was re-determined.
Therefore, there is no error apparent on the face of record
warranting interference with the award passed by
respondent No.2. Accordingly, the petition is dismissed.
However, if the petitioner is aggrieved by the delay in re-
determining the compensation by respondent No.2, it is at
liberty to proceed against respondent No.2 in accordance
with law.”

11. It is to be noticed that the award passed by the
Land Acquisition Officer under Section 28-A of the L.A. Act
was assailed by the beneficiary of the acquisition in the
aforesaid writ petition. In the said case the award of the
Land Acquisition Officer was based on the judgment
rendered in LAC No.470/2012 by the Reference Court and

considering the said aspect as well I am of the considered
view that the petitioner – land owner whose land have
been acquired under the same notification for the same
purpose would be entitled to same compensation as
awarded in case of similarly placed land owners. The Land
Acquisition Officer considering the fact that the nature of
lands in question as well as nature of lands covered in LAC
No.1/2021 are one and the same, proceeded to award
similar compensation by allowing the application of the
land owner under Section 28-A of the L.A. Act. The
beneficiary of the acquisition has failed to establish that
the lands are not similar. Hence, the petitions filed by the
beneficiary challenging the order passed by the Land
Acquisition Officer under Section 28-A of the L.A. Act are
liable to be dismissed. The judgment relied by the learned

others has no application to the case on hand. The co-
ordinate bench in the aforesaid judgment recorded the
finding on the nature of land and acquisition of the land is
not for the purpose of formation of ring road. Hence, the
said judgment is distinguishable on the facts of the case.
It is to be noticed that the judgment of the Reference
Court in LAC No.1/2021 and LAC No.470/2012 have
attained finality and it is claimants who have preferred the
appeal before this Court seeking for higher compensation.
Considering the said aspect as well, the writ petition filed
by the petitioner - beneficiary are liable to be rejected and

under Section 28-A necessary directions are required to be
