amended by Notification No. 01C/2022, dated 03.08.2022 under the quota

The present writ petition has been filed by the petitioner seeking a

mandamus to delete the names of the 4 and 5 respondents from the selection
list, on the ground that they do not qualify under the PSTM quota, since they
pursued their Post Graduate degrees in English medium.

2. The learned counsel for the petitioner contended that the 4 and 5
respondents studied in Periyar University. In this regard, when the petitioner
asked for certain queries from Periyar University, an RTI reply dated
08.11.2022 stated that there was no medium of instruction for M.Sc.

Mathematics in Tamil. Therefore, it is the contention of the petitioner that the
selection of the said respondents under the PSTM quota is liable to be interfered
with, as the very university which has conferred the degree upon them has
categorically mentioned that there was no Tamil medium instruction for M.Sc.
Mathematics. Hence, he prayed to issue a mandamus
3. The said contention was strongly objected to by the learned standing
rd
counsel appearing for the 3 respondent, who contended that the petitioner,
being a MBC candidate, does not have any say in respect of the selection of the
4th and 5th respondents, who come under the BC roster.
4. It is also his contention that the petitioner did not come within the zone
of consideration as he secured only 75.85704 marks, whereas the MBC cut-off
is 81 marks. It is also his contention that a similar challenge by the petitioner to
the selection list, claiming appointment under the PSTM quota, has already
been rejected by this Court in W.P.No.22905 of 2023. Therefore, the question
of raising a similar claim by couching the Writ Petition in a disguised prayer
cannot be entertained. Hence, he prayed to dismiss the writ petition.
5. In addition to the above submission, the learned senior counsel for the
th th th th
4 and 5 respondents submitted that the 4 and 5 respondents had studied
M.Sc. Mathematics in Tamil medium. Even according to the counter statement

of the third respondent, they have directed the user Department to verify the
certificates provided by the respondents 4 and 5, and in furtherance thereof,
their certificates have been verified by the same university, which has given a
certificate stating that all the certificates which includes PSTM certificate are
genuine.
6. The senior counsel further contended that even as per the information
furnished by the University to the respondents 4 and 5, they have categorically
mentioned that even the PSTM certificate has been verified and found to be
genuine. Therefore, it is the contention of the learned senior counsel that the
respondents 4 and 5 have been selected based upon the PSTM quota and
certificates issued by the University in this regard. In which the petitioner
cannot have any say. Hence, he prayed to dismiss the writ petition
7. I have given my anxious consideration to either side submissions.
8. The main contention put forth by the learned counsel for the petitioner
is that, according to the petitioner, the respondents 4 and 5 did not undergo
Tamil medium of instruction while pursuing M.Sc. Mathematics. In this regard,
the petitioner relies upon the RTI reply given by Periyar University. Whereas,
as rightly contended by the learned counsel for the petitioner, the University had
stated that there was no Tamil medium of instruction for M.Sc. Mathematics.

However, it is relevant to note the stand taken by the 3 respondent. According
rd
to the 3 respondent, based upon the complaints and representations received
from the petitioner, they have already directed the user Department to verify the
th th
certificates of the 4 and 5 respondents.
th th
9. In pursuance thereto, it appears that the certificates of the 4 and 5
respondents have been verified and found to be genuine. To substantiate the
th th
same, the 4 and 5 respondents have submitted certificates issued by the
Director, wherein they have awarded the certificate dated 23.06.2025, stating
that the PSTM certificate issued by them is genuine as per the records
th th
maintained by them. Even in the RTI reply furnished to the 4 and 5
respondents, they have also reiterated the above position. Therefore, though the
th th
petitioner has relied upon a certain RTI reply, the 4 and 5 respondents have
now come up with the certificate issued by the University along with the
information furnished by the University that they had studied M.Sc.
Mathematics under the Tamil medium of instruction.
10. In such view of the peculiar circumstances, more particularly, the
dismissal of the earlier writ petition filed by the petitioner in W.P.No.22905 of
2023 vide order dated 24.07.2023, the petitioner cannot reopen his claim by
way for filing this writ petition. It is also relevant to mention the respondents 4
and 5 come under the BC communal roster, whereas the petitioner belongs to

MBC category. Therefore, in view of all the above, this Court does not find any
merit in this writ petition.
11. Accordingly, this Writ Petition is dismissed. Consequently, connected
miscellaneous petition is closed. No costs.
