Order on Board
24/08/2026
1. By way of this petition, the petitioner has prayed for following
reliefs:-
2
“1. The Court may kindly be pleased to pass appropriate
writ(s)/order(s) and direct respondent no. 03 to release
the amount as mentioned in P/1 colly within a time frame
fixed by this Hon'ble Court so that respondent no. 02 can
make payment to the petitioner.
2. Alternatively, the Court may kindly be pleased to pass
appropriate writ(s)/order(s) and direct respondent
authorities to decide the petitioner's representation of P/1
within a time frame fixed by this Hon'ble Court in the
interest of justice.
3. Any other relief/direction that the Court may deem fit in
the facts and circumstances of the case.”
2. Learned counsel for the petitioner submits that the instant petition
has not been preferred against any judgment or order, but is
directed against the inaction on the part of the respondent
authorities, who, despite the specific directions issued by this
Court, have failed to release and remit the amount payable to the
petitioner even after the lapse of nearly 18 months from the date
of the order passed by this Court. It is submitted that this Court
had specifically directed respondent No. 2 to verify and examine
the claim of the petitioner and to release the undisputed amount;
however, despite such direction, respondent No. 2 has merely
addressed communications to the concerned authority, i.e.,
respondent No. 3, requesting release of the requisite funds, but
respondent No. 3 has failed to take any action thereupon. Learned
3
counsel further submits that respondent No. 2 has addressed as
many as six letters to respondent No. 3, dated 03.07.2024,
23.09.2024, 16.01.2025, 27.02.2025, 10.03.2025 and 31.10.2025,
requesting release of the requisite amount, but despite repeated
communications, respondent No. 3 has neither acted upon the
said requests nor taken any effective steps for release of the
amount payable to the petitioner. It is, therefore, submitted that
respondent No. 3, namely, the Officer In-charge, District Mineral
Foundation Trust, may kindly be directed to take immediate and
necessary steps for release of the requisite amount, as requested
by respondent No. 2, so as to give effect to the earlier order
passed by this Court and bring an end to the prolonged
deprivation suffered by the petitioner.
3. On 11.08.2026, learned counsel for the State was directed to seek
instructions in the matter as to whether the undisputed amount
claimed by the petitioner could be disbursed to the petitioner or
not.
4. On instructions, learned counsel for the State submits that, upon
due verification of the claim of the petitioner, if it is found that the
amount is payable to the petitioner and is undisputed, the
competent authority shall pass an appropriate order and take
necessary steps for disbursement of the said amount, subject to
due verification.
5. I have heard learned counsel appearing for the parties and have
perused the material available on record.
4
6. Considering the facts and circumstances of the case, and
particularly the statement made by learned counsel for the State,
the present writ petition is disposed of with a direction to the
concerned respondent authorities to duly verify the claim of the
petitioner. If, upon such verification, the amount claimed by the
petitioner is found to be payable and undisputed, the same shall
be disbursed to the petitioner within a period of 45 days from the
date of receipt of a copy of this order.
7. It is made clear that this Court has not expressed anything on the
merits of the case.
8. With the aforesaid direction, the writ petition is disposed of.
