Special Deputy Commissioner for Abolition of Inams,

petition.

3. Per contra, Sri. Vigneshwara S Shstri, learned
Senior Counsel appearing on behalf of Sri Narendra
Babu A.L, learned counsel for the respondent No.5 to 10,

5. In the light of the submissions made by the
learned counsel appearing for the parties, the land in
question is the land bearing Sy.No.5 of Kalathammanahalli
Village, Hesaraghatta Hobli, Bangalore North Taluk, to an
extent of 2 acres 15 guntas including 6 guntas of karab
land.

6. The petitioner is claiming right through one
Sri Gangaiah (father of the petitioner herein). It is also not
in dispute that the aforementioned village was an Inam
Village. In that view of the matter, taking into
consideration the fact that, the respondent - Authority -
Special Deputy Commissioner for Abolition of Inams,
Bangalore, in Case No.104/59-60 has mentioned the name
of father of the petitioner - Gangaiah as the Jodidar in
respect of the subject land in Sy. No.5 of Kalathamanahalli
Village, and therefore, by looking into the orders passed
by the Special Deputy Commissioner and the respondent
No.2 as there is a discrepancy insofar as the finding

recorded by both the Authorities, and therefore, I am of
view that, it is a fit case to remit the matter to the
respondent No.2 to reconsider the issue afresh by
considering the entire material pertaining to the grant of
land in question under Section 9 of the Mysore (Personal
and Miscellaneous) Inams Abolition Act, 1954 .

7. It is also made clear that this Court has not
expressed any opinion on the merits of the case except
pointing out that, the discrepancy in ignoring the right of
the father of the petitioner in respect of the subject land in
terms of Case No.104/59-60.

8. It is also made clear that all contentions of the
parties are kept open, it is open for the respondent No.2
to reconsider the issue afresh after affording opportunity
of hearing to all the parties are concerned.

9. It is also to be noted that since the parties are
represented through the learned counsel, the parties are

directed to appear before the respondent No.2 on

accordingly set aside.

It is submitted by the learned counsel appearing for
the parties that, the subject matter of land has been
acquired by the competent Authority. In that view of the
matter, till the conclusion of the proceedings before the
