3. Learned counsel for the applicants submits that the applicants are retired
employees who superannuated on 30th June or 31st December of their respective
years of retirement. He submits that, in view of the recent judgment of the Hon’ble
Supreme Court and the DoPT Office Memorandum dated 20.05.2025, similarly
situated employees who retired on the aforesaid dates have been extended the
benefit of the annual increment falling due immediately before their retirement for
the purpose of computation of pensionary benefits.
4. Learned counsel further submits that the respondents have already commenced
implementation of the aforesaid judgment and has drawn the attention of this
Tribunal to the documents placed on record, including the chart at page 48 and the
instance of a similarly situated employee referred to at page 47 of the paper book,
who has been extended the consequential benefits.

5. In view of the submissions made, learned counsel for the respondents is directed
to examine the matter in the light of the judgment of the Hon’ble Supreme Court
and the DoPT Office Memorandum dated 20.05.2025 and take an appropriate
decision on the representations submitted by the applicants.
6. Accordingly, the respondents are directed to consider and decide the
representations of the applicants, in the light of the judgment of the the Hon’ble
Supreme Court in Union of India & Ors. vs. CP Mundammai [(2023) SCC Online SC
312] and Siddharaj B. vs. State of Karnataka & Ors. [(2023) SCC Online SC 871],
and the DoPT Office Memorandum dated 20.05.2025, by passing a reasoned and
speaking order within a period of six weeks from the date of receipt of a copy of
this order.
7. In the event the respondents find the applicants eligible for the aforesaid benefit
in accordance with the applicable rules and instructions, they shall extend the
consequential benefits, including notional fixation of the annual increment, re-
fixation of pension and payment of arrears, as admissible in law.
8. Learned counsel for the applicants submits that, although the present O.A. has
been filed by 89 applicants, some of them may not have submitted individual
representations to the competent authority. He submits that the applicants shall be
at liberty to submit such representations, wherever required.
9. Accordingly, it is directed that the applicants who have not yet submitted
individual representations may do so within four weeks from the date of receipt of

a copy of this order. The respondents shall consider such representations in
accordance with the directions contained herein and the applicable rules and

10. It is further clarified that any other similarly situated employee, who is
otherwise eligible but has not yet submitted a representation, shall also be at liberty
to submit an individual representation to the competent authority within four
weeks from the date of receipt of a copy of this order. The competent authority
shall consider and decide such representation in accordance with law by passing a
reasoned and speaking order.
11. The O.A. stands disposed of in the above terms. There shall be no order as to
costs.
