O R D E R (Oral):-
Per: Justice Sunil Thomas, Judicial Member
The applicant has approached this Tribunal challenging Annexures
A7 and A8. Pending the proceeding, it was submitted by the learned
ACGSC on 21.09.2026, that the inquiry has been completed, in the absence
of any stay of suspension order and that the applicant has been removed
from service with effect from 09.06.2025. Accordingly, the learned Counsel
for the applicant was directed to get instructions. The learned Counsel for
the applicant on instructions submitted today, that pursuant to the order of
removal, an appeal was filed which was declined. A revision was filed,
which is still pending. Having regard to the entire facts, the learned
Counsel sought permission to withdraw the Original Application with
liberty to challenge the order in revision along with the final termination
and order in appeal.
2. Our attention has been drawn to ground numbers (a), (b) and
specifically ground number (d) in which apart from challenging the order of
suspension, the memo of charges and Annexure A8 suspension order are
also challenged on grounds of legal malice. Hence, liberty is granted to the
applicant to challenge the ultimate orders culminating in removal of the
