2. In short, the applicants, three in number,
were promoted to the post of Postmaster
Grade-II on ad-hoc basis vide order dated
10.06.2016 for a period of 11 months. Upon
expiry of the said period and after a gap of
approximately four months, they were
promoted to the same post of Postmaster
Grade-II on regular basis by the respondents
vide order dated 12.10.2017 (Annexure A-2).
3. It is the case of the applicants that, after
completion of the initial period of eleven
months of ad hoc promotion and prior to their
regular promotion, they continued to discharge
the duties and responsibilities of Postmaster
Grade-II. However, subsequently, the
respondents lowered down the pay of the
applicants for the intervening period of
approximately four months falling between the
expiry of 11 months adhoc promotion and their
subsequent promotion on regular basis. The
details of the same have been given by the
applicant in paragraph No.4(x) which is
reproduced hereinbelow :

5. Through the present Original Application, in
nutshell, the applicants are challenging (i) the
lowering down the pay and allowances for the
intervening period of approximately four
months falling between the expiry of their 11
months adhoc promotion and their subsequent
promotion on regular basis, as detailed in the
preceding paragraphs; (ii) demanding the

6. The respondents, in their reply, have stated
that the applicants were at the relevant time
holding the post of Postmaster Grade-I As per
the extant RRs, six years of regular service in
that grade was prescribed to be eligible for
promotion to the post of Postmaster Grade II.
But, in view of acute shortage of the above
cadre officials in Postal Circles, a one-time
relaxation of qualifying service for filling up the
vacancies had been allowed vide the
communication dated 28.04.2016, relevantly
as follows :
"3. Now DOP&T has agreed to one time relaxation of
Qualifying Service for filling up vacancies in the above
Grades subject to following conditions :
(i) The method of recruitment is by promotion only.
(ii) The relaxation in qualifying service is for less
than one year.
(iii) Where relaxation for more than one year and
upto 50% of minimum qualifying service is required
for promotion, the promotion shall not be treated as
regular.
4. In view of the above, Circles are requested to take
necessary action for the filing of vacant posts for the
cadre of Postmaster Grade-II and Postmaster Grade-III
and report the compliance of the same to this office."

post of Postmaster Grade-II in the post offices
of Jaipur City Division under the Rajasthan
Postal Circle purely on adhoc basis vide
respondent No.3 memo No.B3-2/115/GR-
II/2016 dated 10.06.2016. In the said memo, it
was clearly mentioned that officials of
Postmasters Grade-I cadre ordered to work on
Postmaster Grade-II cadre in various
Regions/post offices will do so purely on adhoc
basis in the interest of the service in the Pay
Band-2 of Rs.9,300-34,800/- with Grade Pay
of Rs.4,200/- for eleven months with effect
from the date of assumption of charge or until
availability of regular incumbent of Postmaster
Grade-II, cadre whichever is earlier.
8. It was also stated in the said memo dated
10.06.2016 that "the adhoc arrangement of the
above officials will not have any right of regular
absorption in the Grade. It will also not be
counted for seniority etc." The Applicants had
joined adhoc promotion on (11.07.2016,
01.07.2016, 01.07.2016) respectively and had
completed 11 months of adhoc service on
(10.06.2017, 01.06.2017, 31.05.2017)

pay and allowances paid to the Applicants
from the date of their having completed the
maximum period of 11 months as ad-hoc
Postmaster Grade-II till 16.10.2017 were
ordered for recovery.
9. The respondents have further stated that the
relaxation in eligibility inter alia for the
promotion to the cadre of Postmaster Grade-II
was made under certain conditions as per
instruction dated 28.04.2016 issued by the
Department of Posts, which was not an open-
ended order but only a one-time measure to
overcome the situation of acute shortage of
the staff in the postal circles. As such, this can
neither be operated again and again, nor any
of the condition including crucial / cutoff date
can be changed.
10. It was also submitted that even after
relaxation in qualifying service as per letter
dated 28.04.2016, the applicants were not
eligible for regular promotion as Postmaster
Grade-II as per the para 3(ii) therein, since the
shortfall in each of their qualifying service
length as Postmaster Grade-I was not less
than one year on the date that they were
offered to be posted as Postmaster Grade-II.
Hence, as per condition provided in para 3(iii)
their promotion shall not be treated as regular.

Adhoc arrangements, but had not done so and
had also joined as Postmaster Grade-II on ad-
hoc basis consciously without any protest.
Hence, the action of the respondents is legal,
just and proper as per law on the subject
which is evident from the foregoing paras.
11. We have heard the learned counsels for
both the parties and carefully perused the
pleadings, documents and materials available
on record.
12. As regards the first relief sought by the
applicants i.e. lowering down of their pay for
the period of approximately four months
intervening between the expiry of their 11
months adhoc promotion and their subsequent
promotion on regular basis, a bare perusal of
the letter dated 14.11.2017 (Annexure A-14)
makes it evident that, even after expiry of the
11 months period of their adhoc promotion on
the post of Postmaster Grade-II, the applicants
continued to discharge the duties and
responsibilities attached to the said post.

an employer has availed the services of an
employee on a higher post and has extracted
work involving higher duties and
responsibilities, the corresponding monetary
benefits attached to such post cannot be

denied. This principle has also been
reaffirmed by the Hon'ble High Court of Orissa
at Cuttack in its judgment dated 07.05.2026 in
the case of Union of India and others Vs.
Gangadhar Prusty, which is placed before us
by the learned counsel for the applicants. The
relevant paragraph No.6 of the same is
reproduced hereunder :
"6. It is well settled that once the employer had
consciously availed the services of the Respondent in
the higher post and extracted work carrying higher
responsibilities and duties attached thereto, denial of
the corresponding monetary benefits would be
manifestly arbitrary and inequitable. Though ad hoc
promotion by itself may not create a vested right to
regularisation or substantive promotion, the same
cannot be utilised as a mechanism to deny the
employee the financial benefits attached to the post
against which he had in fact worked.
14. Now, coming to the second issue, whereby
the applicants are seeking counting of the
service rendered by them on adhoc basis in
the post of Postmaster Grade-II towards
regular service for the purposes of seniority
and promotion in the said post, we have
carefully perused the order dated 10.06.2016.
From the said order, it is evident that (a) the
applicants were permitted and allowed to work
on the post of Postmaster Grade-II on adhoc
basis, after giving them relaxation in the
eligibility conditions for promotion to the cadre
of Postmaster Grade-II in pursuance of the

Director (SPN), New Delhi mentioned therein;
(b) the said arrangement was purely on adhoc
basis; and (c) the arrangement was made for a
specific period of 11 months. It was
specifically stipulated in the said order that
" the adhoc arrangement of the above
officials will not have any right of regular
absorption in the Grade. It will also not
count for seniority also etc. "
15. Thus, it is evident from the aforesaid terms
and conditions that the applicants were
granted promotion on adhoc basis subject to
the specific stipulations that the service
rendered by them on adhoc basis would
neither confer any right of regular absorption in
the Grade nor be counted towards seniority or
for any other such purpose. It is also
pertinent to note that the applicants were,
in fact, not eligible for promotion to the
post of Postmaster Grade-II as per the
extant RRs. Even pursuant to the letter dated
28.04.2016 issued by the Assistant Director
(SPN), New Delhi for relaxation in the eligibility
conditions as a one time measure in order to
overcome the acute shortage of staff, the
applicants were not found eligible as on

16. In other words, the applicants were not
eligible for promotion to the post of Postmaster
Grade-II as per the extant RRs. It was only an
arrangement made by the authorities in the
interest of organization and pursuant to the
aforesaid relaxation granted as a one-time
measure. Therefore, the applicants cannot
claim the benefit of counting the period of such
adhoc service towards regular service as
Postmaster Grade-II, particularly when, but for
the said relaxation, they would not have been
eligible for such promotion and the order of
adhoc promotion itself contained a specific
stipulation that the said period would not be
counted for the purposes of seniority etc. The
applicants consciously accepted the aforesaid
adhoc promotion order and joined the post of
Postmaster Grade-II subject to the terms and
conditions stipulated therein. It is also
pertinent to note that the applicants have not

above officials will be counted w.e.f. date of joining in

18. Thus, it is evident that the regular

Postmaster Grade-II cadre for the purposes of

20. Now coming to the third issue whereby the
applicants are seeking to be given similar
treatment as allowed by the similarly situated
employees in other Postal Circles, viz. Bihar,
Orissa, Delhi and Gujarat, in respect of whom
the Annexure- A/9, A/10, A/11 & A/12
respectively shows that promotions were
allowed to officials in Postmaster Grade-I on
regular basis to Postmaster Grade-II. The
applicants had tried to make the case that all
those officials had passed the Postmaster
Grade-I examination in the year 2011 and had
admittedly joined in the said post in end-
August 2011 or beginning of September 2011,
together with the applicants - hence they were
claimed to be similarly situated as the
applicants.
Relevantly in this regard, the letter dated
28.04.2016 of the Department of Posts
addressed to all Postal Circle CPMGs, it had
been clearly specified that the existing RRs for
promotion of Postmaster Grade-I officials to
Postmaster Grade-II prescribes 06 years of
regular service to be eligible. Further,
relaxation of qualifying service for filling up the
vacancies in the grade of Postmaster Grade-II

been made subject to the conditions specified
therein as noted herein before.
21. On being seen in light of the letter dated
28.04.2016 aforesaid, it emerges that on the
date the applicants had been granted
promotion as Postmaster Grade-II vide order
dated 10.06.2016 ; and further on the dates
that they had joined as such, viz. 11.07.2016,
02.07.2016 and 01.07.2016, respectively –
none of the applicants had completed 05 years
of regular service in the grade of Postmaster
Grade-I. Thus, they were not meeting the
condition in clause 3 (ii) and had required
more than one year of relaxation in qualifying
service vis-à-vis the extant RRs. Hence, as per
clause-3(iii), their promotion shall not be
treated as regular.
Per contra, from the Annexure Nos.9, 10,
11 and 12 placed on record by the applicants
themselves , it emerges that those officials
were promoted in Bihar Postal Circle on
23.12.2016, in Orissa Postal Circle on
11.01.2017, in Delhi Postal Circle on
31.03.2017 and in Gujarat Postal Circle on
21.04.2017. Thus, on such respective dates,
all of those officials had rendered 05 years or
more of regular service in the grade of
Postmaster Grade-I. Hence, they were fulfilling
the condition in clause 3(ii) of letter dated

28.04.2016 and had required less than one
year of relaxation in qualifying service vis-à-vis
the extant RRs. Thus, the provision of Clause-
3(iii) would not be attracted in case of those
officials; and there was no bar in treating their
promotion as Post Master Grade-II as regular,
with effect from the applicable respective
dates.
22. Accordingly, it is concluded that mere entry
through the same Postmaster Grade-I
examination in the year 2011 would not confer
perpetual similarity in every situation, which
had to be determined as per the specific facts
of the situation under consideration.
Specifically, in the situation presently being
considered, viz. the matter of promotion from
the Postmaster Grade-I to the Postmaster
Grade-II while allowing relaxation of eligibility
of regular service as a one-time measure vide
the letter dated 28.04.2016, we found as
aforesaid in the facts as brought out from the
documents submitted by the applicant
themselves that the applicants were not
actually similarly situated to the other officials
in different Postal Circles ; and their claim, as
such, was untenable and inadmissible.
23. Also it was further noted that the
relaxation in the eligibility condition of 06 years

inter alia , was accorded as a one-time
measure. The one relaxation in the case of the
applicants had been exercised vide their
having joined as ad-hoc Post Master Grade-II
in pursuance of the order dated 10.06.2016
issued by the office of the CPMG, Rajasthan
Circle. Hence, we are in agreement with the
contentions of the respondents that while the
applicants could have refused such promotion
on ad-hoc basis, however having accepted the
same without any protest and joined in
consequence of the order dated 10.06.2016, it
would no more be open to the applicants to
seek the support of the letter dated 28.04.2016
for seeking another relaxation a second time
and claim for regular promotion thereunder,
after completing 05 years of service. In light of
the same also, we again hold that the
applicants’ promotion to the Postmaster
Grade-II, having once been allowed on adhoc
basis vide the order dated 10.06.2016, cannot
be considered for a second time by applying
the relaxation in the regular service
requirement as per the RRs after they had
completed 05 years of regular service from
their entry in the Postmaster Grade-I, for a part
of which, they had functioned as adhoc
Postmaster Grade-II.

24. In view of the foregoing discussion, the
applicants are not entitled to the third relief
sought by them, i.e. to be given – by modifying
orders passed by respondent Nos.2 & 3 time-

treatment as allowed to other employees in
other postal circles.

There shall be no order as to costs.
