[2] Factual matrix in a nutshell is that R1 to R3 in captioned CRP/MC
application filed a plaint dated 26.08.2025 in said trial court with prayers inter-
alia for declaration that they are entitled to recover costs of construction of
houses amounting to a little over 1.27 crores (1,27,35,000/- to be precise) and
other reliefs. In this suit, CRTM is the defendant; that interestingly and
intriguingly President, Secretary, Treasurer and two member trustees of
CRTM, Manipur have been shown as 1 to 5 qua CRTM though they all have
been described as representing CRTM and in this regard cause title in the
plaint is as follows:

…Proforma Respondents’

that, this Court is of the view that a relook into afore-referred aspect qua
array of parties is necessary but this 227 Court refrains from doing so in instant
Page 7 of 21

2026:MNHC:250

case owing to the limited legal perimeter of captioned CRP; that it is made
clear that this aspect will be gone into in another matter where it becomes
imperative; that post filing of suit and service of suit summons, CRTM filed
written statement dated 29.04.2026 along with 6(six) documents; that there
was delay in filing this written statement and therefore, CRTM took out an
application being Judl. Misc. No.148 of 2026 with a prayer for Condonation of
Delay ( CoD ) qua 113 days; that this CoD application being Judl. Misc. Case
No.148 of 2026 was allowed by said trial court in and by an order dated
03.06.2026 and a scanned reproduction of this order is as follows:

2026:MNHC:250

2026:MNHC:250

That, afore-referred Judl. Misc. Case No.148 of 2026 has been taken
out by resorting to Section 5 of the Limitation Act, 1963 (36 of 1963) instead
of proviso qua Order VIII Rule 1 CPC ; that quoting wrong provision of law does
neither disentitles an applicant from getting relief nor denudes the court of
powers to grant relief; that as already alluded to in the earlier part of this
narration, afore-referred CoD application being Judl. Misc. Case No.148 of
2026 has been allowed by the said trial court, more so, after recording that the
plaintiffs refrain from opposing the CoD prayer in the interest of speedy trial.
To be noted, the entire order condoning delay in filing written statement has
been scanned and reproduced supra. It comes to light that after Condonation
of Delay ( CoD ) in filing written statement, said trial court has framed issues on
05.08.2026; that it is seen that though it is framing of issues, said trial court
has recorded as ‘ POINTS FOR DETERMINATION’ . Nonetheless, learned
counsel on record for CRP petitioner states at the Bar that 5(five) issues have
Page 10 of 21

2026:MNHC:250

been framed and a copy has been placed before this Court and scanned
reproduction of the same is as follows:

2026:MNHC:250

To be noted, 05.08.2026 proceedings of said trial court is as
follows:

[3] Be that as it may, post framing of issues on 05.08.2026, suit has
been listed for further proceedings on 09.09.2026 and examination of witness.
Examination of PW1 is now underway (16.10.2026) and the case now stands
over to 02.11.2026. A scanned reproduction of case status downloaded from
the official website is as follows:

2026:MNHC:250

2026:MNHC:250

2026:MNHC:250

[4] Be that as it may, what is causing difficulty is, along with the
afore-referred CoD application being Judl. Misc. Case No.148 of 2026, CRTM
has taken out another Judicial Misc. Case being Judl. Misc. Case No.149 of
2026 purportedly under Order VIII Rule 1 CPC read with Section 151 CPC
with a rather strange prayer to grant leave to CRTM to proceed in the matter
Page 15 of 21

2026:MNHC:250

on merit and scanned reproduction of this Judl. Misc. Case No.149 of 2026
petition is as follows:

2026:MNHC:250

2026:MNHC:250

[5] The afore-referred Judl. Misc. Case No.149 of 2026 has been
given a closure by the said trial court vide impugned order dated 03.06.2026
and scanned reproduction of the impugned order is as follows:

2026:MNHC:250

2026:MNHC:250

[6] It is clear from the narration thus far that dismissal of Judl. Misc.
Case No.149 of 2026 primarily on the ground that the court is not clear as to
what prayer is to be granted to the applicant does not in any manner affect
CRTM as suit is proceeding on merits. This Court also notices that plaintiffs,
in their response to CoD application have made it clear that they are not
opposing the CoD prayer in the interest of speedy trial.
[7] As the suit is now proceeding on merits and as the impugned
order does not affect the CRTM (CRP petitioner/MC applicant) in any manner
no useful purpose will be served by issuing notice as that would only delay the
matter. This is more so, as the plaintiffs are also interested in speedy trial as
is evident from their stated position captured in CoD order. Therefore, it will
suffice to give a closure to the captioned CRP and captioned MC thereat by
saying that the impugned order does not affect the rights and contentions of
both sides, be it the 3(three) plaintiffs or the CRTM and the suit/trial will
continue to proceed on merits for being carried to its logical end. The
impugned order shall merely be construed as an order saying that Judl. Misc.
Case No.149 of 2026 is completely uncalled for and a rather strange and
superfluous prayer has been made. To be noted, it is axiomatic that if the
impugned order had been construed in any other manner by said trial court,
CRTM or plaintiffs in said trial court the suit/trial will not now be proceeding on
merits.
[8] Let the said trial court proceed with the trial, continue the suit and
conclude the same as expeditiously as the official business of the said trial
Page 20 of 21

2026:MNHC:250

court would permit and this is subject to prior to suits and pendency in the said
court.
[9] Captioned CRP is disposed of as closed in the aforesaid manner
albeit with preservation of rights and contentions of both sides in the aforesaid
manner and with observations as above. Consequently, captioned MC thereat
has become otiose and the same is also disposed as closed. There shall be

no order as to costs.
