1. Present original application has been filed by the applicant
under Section 19 of the Administrative Tribunals Act, 1985,
seeking following relief:-
ii) That the promotion order dated 01.08.2016 (Α-16) qua
respondent No.3 be quashed and set aside and
consequently, the respondents be directed to promote the
applicant as Mistress (Hindi) under 1% quota as per
notification dated 10.03.2009 with all consequential benefits
at par with the individuals promoted in pursuance to memo
dated 18.07.2014 vide order dated 24.11.2014.

2. Briefly stated facts of the case are as follows. The applicant
joined as Clerk in the respondent department on 06.04.1990
and on completion of 5 years service she was placed as Junior
Assistant and promoted as Sr. Assistant on 02.06.2015. The
applicant is B.A. B.Ed. (Hindi). The applicant is eligible for the
post of Mistress (Hindi) as per Rules issued ‘Chandigarh
Education Service (School Cadre) (Group-C) Recruitment
Rules, 1991’, vide Notification dated 10.03.2009, the
respondents made amendment in the Chandigarh Education
Service (School Cadre) (Group-C) Recruitment Rules, 1991 by
making provisions for promotion to the post of Master/Mistress
from amongst J.B.T. Teachers, Nursery Teacher, C & V Teacher
(Drawing Teacher), P.T.I and Work Experience Instructors and
Senior Laboratory Attendant/Ministerial Staff in the ratio of
70:15:14:1.

3. On 08.06.2009, memo dated 18.06.2009 was circulated by the
respondent No.2 vide which applications for promotion to the
post of Master/Mistress were invited from the eligible
employees by clearing subject-wise vacancies for promotion.
The applicant being eligible for promotion to the post of
Master/Mistress (Hindi) under 1% quota, applied for the
aforesaid post but no action was taken by the respondents to
consider the case of the applicant for promotion under 1%
quota against the aforesaid posts.
4. In April, 2013, vide letter dated 23.04.2013, the respondents
again asked for cases for promotion from all eligible candidates
amongst J.B.T./N.T.T. and Ministerial Staff for promotion as
Master/Mistress. The applicant being eligible for promotion
under 1% quota applied for the post of TGT Master/Mistress
(Hindi) by submitting all necessary documents and certificates
to respondents. In response to aforesaid application, District
Education Officer issued memo dated 16.07.2014 to the
Principal, Govt. Model Sr. Secondary School, Sector 15,
Chandigarh and demanded the latest No Enquiry pending
certificate of the Ministerial and SLA staff who have applied for
promotion as Master/ Mistress. In response to the aforesaid
memo, the Principal submitted the latest No Enquiry is pending
against applicant and also submitted that no case is pending as
on 1.1.2012.

5. The respondents issued notice dated 19.09.2014 of those who
have submitted their applications for promotion to the post
Master/Mistress amongst JBT/NTT/C&V/SLA and Ministerial
Staff and the name of the applicant stands at S.No.12 in the
aforesaid notice. The name of the respondent No.3 stand at
S.No.16 in the aforesaid list.
6. The respondents issued another list on 07.10.2014 of
candidates who have applied for promotion as TGT, the
applicant stands at Sr. No.12 of the aforesaid list and the
respondent No.3 stands at S.No.16. In the remarks column of
the said list against the name of the applicant, the remarks
were given that the Elective Subject not at Graduation Level
and submitted undertaking subject to clarification from the
University. In order to remove the aforesaid objection, on the
same day, the applicant took leave and went to Punjab
University and obtained a duplicate certificate, which shows
that the applicant has studied Hindi as Elective subject at
Graduation level. The applicant submitted the said certificate
to the office of the respondent on 07.10.2014.
7. The respondents scrutinized all the documents of the applicant
and original certificates were checked and their self-attested
photo copies were taken by dealing hand and the applicant
was told that her case was found complete in all respects.

8. The respondents granted promotion to the other categories,
who have applied along-with the applicant under different
quotas as is evident from the order dated 13/15.04.2015
excluding the category of the applicant under 1% quota as
mentioned in the Notification dated 10.03.2009.
9. Thereafter respondent No.2 vide letter dated 06.11.2015, duly
endorsed by DEO (U.T.) issued letter dated 09.11.2015 and
asked to send cases eligible JBT/NTT/C&V and Ministerial staff
for promotion as TGT upto 18.11.2015. According to applicant
nowhere in this letter dated 6.11.2015, it has been stated that
the person like applicant who have already applied earlier for
promotion are required to again apply for the same afresh. The
case of the applicant was already pending with the
respondents and she was repeatedly shown at S. No.5 and 12
in the list of eligible candidates for promotion issued on
07.10.2014 and 19.09.2014. All the documents and
certificates submitted by the applicant already have been
checked respondents and no complaint was pending against
the applicant. ACR of the applicant was also up to mark.
10. The District Education Officer (U.T.), Chandigarh vide letter
dated 23.11.2015 returned the case file of the applicant after
the cut-off date of 18.11.2015 for submission of application
without any remarks or objections and without any instructions
to re-submit the same. Hence the applicant prepared her case

for promotion for the post of TGT on same day under 1%
quota as per Notification dated 10.03.2009 and approached
respondent department wherein the dealing hand of the
respondent department told applicant that the last date for the
submission of cases was up to 18.11.2015. No
intimation/instruction was given to her to resubmit. When
applicant did not find her name in the list displayed on the net
on 27.06.2016. Applicant gave representation on 26.07.2016
(Annexure A-11) but no action was taken on it.
11. The respondents issued promotion order dated 01.08.2016
whereby junior to the applicant i.e. respondent No.3 was
promoted as Mistress (Hindi). The respondent No.3 is at
S.No.5 at the aforesaid order. Aggrieved by the action of the
respondents, applicant submitted representation dated
26.07.2016 prior to promotion order dated 1.1.2018 followed
by another representation subsequently dated 03.08.2016 but
received no response.
12. One Sh. Inderjit sought information under RTI Act, 2005
from the respondents and asked about the minutes of meeting,
vide which aforesaid individuals were promoted. Respondents
vide letter dated 5.9.2016 supplied relevant information along
with the documents. The respondents had bifurcated the 1%
quota as 1:3 ratio i.e. 1 post for SLA and 3 posts for Ministerial
Staff. The official respondents have promoted the respondent

no.3 as Mistress (Hindi), who is junior to the applicant. The
respondent no.3 was appointed in the department on 6.4.1991
as Clerk, whereas the applicant has joined the department on
6.4.1990 as a Clerk as is evident from the lists mentioned in
Annexure A-10 and Annexure A-11. Thus, respondent no. 3 is
junior to the applicant and action of the respondents in
denying promotion to applicant and promoting junior as
Mistress Hindi is illegal and arbitrary. Hence, the present O.Α.
13. Respondents No.1 and 2 have filed reply on 13.02.2018
taking preliminary objection with regard to delay and non-
joinder of necessary parties. It has further been stated that
with regard to the discrepancy as mentioned by the applicant,
the same was considered in the DPC held on 22.12.2014. But
the names from the SLA/Ministerial cadre was not
recommended for promotion due to non finalization of the
distribution of posts amongst SLA & Ministerial cadre for
promotion to the post of TGT (Masters/Mistresses).
Respondent department again invited applications for filling up
the various post of TGTs from the feeding cadre
JBT/NTT/C&V/SLA/ Ministerial cadre vide this office letter
No.5541-DPI-UT-S2-11(33)2012 dated 06.11.2015 (Annexure
R-1) From perusal of office record it has come to the notice
that Mrs. Rekha Rani did not apply for promotion when
applications were invited by the department on 06.11.2015.

Last opportunity was also given by uploading the said list on
official website of Education Department, Chandigarh on
27.06.2016 (Annexure R-2) for submission of any kind of
objection/discrepancy with regard to the particulars or
seniority to be considered by DPC for promotion (Annexure R-
2). The claim of the applicant cannot be entertained at this
belated stage.
14. Respondent No.3 has filed reply on 13.02.2018 submitting
therein that letter dated 06.11.2015 was verbatim same as the
previous letters dated 08.06.2009, 15/23.04.2013 and
16.07.2017 etc. based upon which the applicant had applied
for consideration for promotion as Mistress (Hindi). The
Applicant is estopped by her own conduct as she herself took a
decision, not to apply pursuant to notice dated 06.11.2015. It
is further stated there under 1% quota, there were 2 vacancies
available not 1 and as per seniority even the case of applicant
can be considered. The same official respondents in another
OA No.060/00249/2016 with same subject matter have taken
a specific stand that the promotion under 1% quota are made
on the basis of seniority and not subject wise seniority. The
Respondent No.3 was promoted in her respective quota as per
the updated record prepared and available with respondents to
consider the claims and has no role to play so far as her
promotion is concerned or non promotion of applicant is

concerned. The Respondent No. 3 is working on the promoted
post of Mistress continuously since her promotion vide order
dated 01.08.2016, she has been confirmed as such vide order
dated 13.10.2017 (Annexure R - 3/3 ) and it will be unjust,
harsh, humiliation, will be un-equitable to revert her without
any fault or reason attributable to her on a lower post and in
lower pay scale after such a long time.
15. We have perused facts on record as well as written
statement filed by the respondents. We find that respondent
No.2 vide letter dated 06.11.2015 duly endorsed to DEO U.T.
with reference to promotion as Masters/Mistresses from the
leading cadre JBT/NTT/V&V & Ministerial cadre requested the
DEO to send cases of eligible teachers in prescribed
proforma along with relevant documents. This copy was
endorsed by DEO to Heads of Government School/BEO,
UT Chandigarh to send the cases of eligible
JET/NTT/C&V teachers separately along with relevant
documents up to 18.11.2015 (Annexure A-14). Following this
communication, names of eligible teachers were sent however
name of the applicant though eligible was not sent by
the Principal. No explanation is forthwith coming as to
why her name was not sent/excluded . Perusal of
Annexure A-15 shows that on 23.11.2015 promotion case/ACR
file in respect of Rekha Rani was returned to the Principal of

GMSSS, Sector-15, Chandigarh. Even then it was not re-
forwarded by the Principal to DEO in pursuance of letter dated
06.11.2015. Perusal of A-1 makes it clear that respondents
were very casual in their approach even though applicant filed
representation on 27.6.2016, the day list was displayed on
net. Hence the contention of respondent No.1 and 2 that she
did not object is without any basis in view of her
representation dated on 27.06.2016 itself. We find no action
was taken on this representation. The respondents have not
been able to explain this inaction. Then without considering
her representation dated 28.07.2016, eligible teachers were
promoted on 01.08.2016 and name of the applicant was
obviously not in this promotion list (Annexure A-16). We find
the behaviour of respondents very callous and inexplicable.
16. We have also perused Annexure A-17 being minutes of DPC
meeting held on 20.07.2016 for considering the case of
JBT/NTT/C&V (Drawing Teacher, PTI & Work Experience
Instructor etc.) and Sr. Lab Attendant/Ministerial Cadre. We
find that the file of the applicant was with the authorities
concerned i.e. District Education Officer on the last date of
submission of names i.e. 18.11.2015. Applicant genuinely
believed that since her documents were already with DEO,
there is no need to apply again. File was however returned
on 23.11.2015 without any remarks . Applicant then

appears to have approached respondent department and
claims that dealing hand of the respondent department as
detailed in Annexure A-1 told her that last date of submission
was 18.11.2015. It is apparent to us that due to this
casualness resulting in communication gap, the case of
the applicant though eligible was not considered in the
DPC held on 20.07.2016 . So not finding her name in
promotion order, she submitted representations dated
26.07.2016 and 03.08.2016 (Annexure A1 and A-2) seeking
promotion but the same have not yet been considered.
17. From records it is clear that the candidature of the applicant
had been considered in November 2014, it was when all the
documents were checked including self attested copies were
submitted to dealing hand. However on 24.11.2014,
respondents granted promotion to all categories under
different quotas but not to the category of the applicant.
Applicant had applied under 1% quota as mentioned in
notification dated 10.3.2019 and they could not bifurcate the
quota. Subsequent notification of 06.11.2015 duly endorsed by
DEO UT vide letter dated 09.11.2015 asking Principals to send
cases of eligible candidates did not say that persons like
applicant who have already applied earlier for promotion and
whose documents are with DEO office are required to apply
afresh. While some other candidates may have applied afresh,

applicant did not in the absence of any specific
requirement/instructions to do so and the fact her file
complete in all respects was already in the office of DEO.
Consequently, respondent No.3 who is junior to applicant was
promoted as Mistress Hindi. Since applicant had submitted all
documents prior to 18.11.2015, the confusion of the applicant
whether she was required to re-apply/resubmit documents
appears to us to be genuine especially as no
clarification/guidance either by office DEO or the Principal of
her school seems to be forthcoming on this issue. Strangely,
we find that the Principal also omitted to send her name and
did not point out to the authorities that she is eligible and that
her file is in DEO office itself.
18. Respondents have argued though applicant did not apply for
the promotion when department asked for application on
06.11.2015, last opportunity was also given by uploading the
said list on official website of Education Department
Chandigarh on 27.06.2016 and for submission of any kind of
objection/discrepancy with regard to particulars or seniority to
be considered by DPC for promotion. List was uploaded on
website on 27.06.2016 (Annexure R-2). However, the
applicant did not file any objection and hence claim of the
applicant cannot be entertained at this belated stage by the
respondents. We find this argument is not supported by facts

as her representation dated 27.06.2016 was not considered
before issue of promotion order on 01.08.2016.
19. After considering facts and circumstances, we find that the
applicant was eligible and all her documents were also
available with District Education Officers prior to cut off date of
18.11.2015. Hence the averment by respondents in this
regard is not acceptable as they appear to be an afterthought.
Due to lack of proper communication, applicant did not
resubmit her documents in response to letter dated
06.11.2015. In fact by the letter dated 06.11.2015 duty was
cast upon Head of School to send cases of all eligible
candidates. It has not been explained why her name was not
initially sent by Principal and why when this was noticed on
23.11.2015, her name was not again forwarded by Principal
pointing out error in the original list sent by him. She did
represent on 27.06.2016 after the list was uploaded calling for
objections. We understand no action was taken on
representation by respondents. There are lot of questions not
answered by the respondents nor proper reasons are
forthcoming for these discrepancies, omission and lacunae. In
the circumstances, hence having legitimate expectations of
promotion we are of the view that the applicant being duly
eligible should have been given the opportunity due to her and
should have been considered for promotion at the relevant

time. The inaction in the circumstances, on part of
respondents depriving applicant her due cannot be condoned.
20. The applicant has already superannuated on 30.04.2026
hence it would be in fitness of things if she is promoted
notionally at least now. Accordingly, the respondents are
directed to promote the applicant on notional basis from due
date with consequential benefit as due and admissible to her
including pensionary benefits. The O.A. stand allowed. The
action in this regard should be completed within a period of
eight weeks from receipt of certified copy of this order. No
costs.
